This is in the incorrect place you will not get the help you need here. I'm moving it to the correct forums.

Hi, I think you were asked earlier by the other person why you are sending the I-130 probably cause they weren't sure as to what visa you came in cause I think if you had come in with a K-1, you won't have to file that. But back to your questions, so far so good, I personally think you are on the right track from what I have read so far. Just send it all out and start gathering together as much more evidences you can before your interview which I think is still months away.

Good luck!

3/21/2012 (Day 0) - I-130, I-485 and I-765 sent.

3/23/2012 (Day 1) - Delivered to USCIS.

3/28/2012 (Day 6) - One check for $1,490 cashed & cleared for I-130 and I-485.

4/10/2012 (Day 19) - Case status online says changed to RFE received.

4/12/2012 (Day 21) - Successful biometric done.

5/11/2012 (Day 50) - Complete RFE (I-864) received. Case status online changed to RFE received.

She is not adjusting from a family based visa she is adjusting from a B2 tourist visa. Your question has been moved to the adjustment of status from work / student / tourist section. The appropriate section for your question and your issues.

You have all you need initially - as has been said, collect more for your interview. Initially you are required to send a copy of your marriage certificate, any divorce papers if applicable, the g-325 and passport style pictures.

Out of the following you should include one for the initial filing:

Documentation showing joint ownership or property; or

F. A lease showing joint tenancy of a common residence;or

G. Documentation showing co-mingling of financial resources; or

H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or

I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or

J. Any other relevant documentation to establish that there is an ongoing marital union.

Anything beyond one of those is OPTIONAL for initial filing. You will have an interview with an AOS case, allowing you opportunity to present further evidence.

Collecting as many of those things as you can rack up prior to your interview will be helpful.
