PLS HELP I BADLY NEEDED YOUR ADVICE REGARDING THIS RFE THING-----

MY FIANCE AND I MET DURING OUR COLLEGE DAYS YEAR 2002. WE BECAME LOVERS YEAR 2003 and CONTINUE STUDYING UNTIL 2005 and GRADUATED.

HE WENT BACK TO THE STATES FOR GOOD AND YEARLY HE SPENTS HIS 1-2 month VACATION HERE FROM 2006 to 2009.

YEAR 2009 IS THE LAST YEAR WE MET... he didnt spent his vacation just to file

his citizenship and due to financial constraints and NOW ITS ALREDY 2012 past 2 years since we last met

WHAT TO

DO??? what to tell the uscis people???

You will need to withdraw your petition, meet in person, then file again. You MUST have met in person within the 2 years prior to filing the I-129F. There is no way around this. The instructions are very clear about this.

You did not meet in person within 2 years prior to submitting the petition. You must withdraw it, lose the money you submitted because you didn't read the instructions, then arrange to meet in person again, document that meeting and then submit again, including a waiver letter. Not a big deal except please read the instructions more carefully next time. Ask questions here if you need.

This is not a difficult process.

arrange for meet up, spend time/vacation together, save all evidence, like boarding pass, pictures, iterinary, hotel bills, etc anything you can gather then refile or get married in PI then file cr1

The reason for the RFE is:

K-1 visa requires you met within 2yrs of filing the I-129f petition. The last time you met was 2009. So you did not meet in the last 2yrs prior to filing the K-1 petition. You will need met this year. He needs to book a flight to the Philippines. Take lots of pictures of you two together and family if possible, save plane tickets, hotel receipts, restaurants receipts etc.. Anything that will show proof of him being there this year. Also chat logs, YM, Facebook, Skype, emails, gifts etc from 2011 - 2012.

You will need to cancel the current I-129F petition (There are no refunds). Meet in person as I have stated above. Once he returns home (US). File the I-129f petition again. Then submit the proof of relationship and all other requirements and documents. Pay the fee again.

its may 2012 and last feb 2009 is the last time we met

what to write on the letter? can we still have the chance?

anyway hardship on part of the usc is about employment and monthly bills and existing credits

You will not be approved without having met in person within the last two years.

Your US fiance should send a letter withdrawing the petition. Then you arrange to meet, and only after that, send a new petition.

The answer remains the same as from the first time you asked. Your fiance must withdraw the petition. It will be denied otherwise. The two of you must meet in person face-to-face, then use the evidence of that meeting to file a new petition. He will not be granted a hardship waiver for not having met in the last 2 years, especially if he would be claiming he is too poor to travel. How will he provide the affidavit of support for you if he cannot even afford to visit you even once in the last 2 years? Waiver is not going to happen.

Again, withdraw the petition. Manage to meet in person when you can. File after that meeting. Also, keep in mind he will be needing to provide that affidavit of support after you get an approved petition, and he will need to be earning 125% of the poverty level for his household size plus the beneficiary.

They are very very strict about the meeting in 2 year requirement. Not having money is not a reason they will accept for not doing that. If he doens't have the funds to travel then they will expect you to buy his ticket or travel yourself.

This will not be over quickly. You will not enjoy this.

It is free to try. The result will be "NO"

You are filing a petition that requires the payment of considerable fees, before and after you arrive, a visa that does not allow you to work on arrival but obligates your fiance to support you and to prove TWO TIMES he can do so. And you want to say he cannot afford to visit you?

Plan a visit and then file. You may also, as adults comtemplating marriage, discuss exactly HOW you are going to live and pay for all your expenses if he canoot afford a visit.

That is a red flag right there for visa refusal because your fiance's financial capacity is a requirement.

I would assume you're the beneficiary from the Philippines. Visiting him is also another hurdle for you because tourist visa requires you to prove you are coming back to the Phils.
