We are on the process of waiting in line for the petition approval. We filed for a k3 but now I am confused if there's a way to shift to I-130 path? I've heard the 129f petition gets an approval first compare to I-130 petition . So what steps to do if it'a allowed to shift to CR-1? Help pls. I am really confused now unsure.gif

Please, go to the Wiki are of this forum http://www.visajourn...x.php/Main_Page and get acquainted with the different types of visas.

For starters though, the K1 VISA (I-129f form) only applies to UNMARRIED people (one of them being a USC) seeking to marry in US soil and remain there; therefore, it would not apply to you, because if you have applied for a K3 visa (spousal visa), it means you have already married.

if you are married you cannot file i 129...i 129 is fiance visa...i 130 spouse

The I-129F form is also used on the K-3 process...

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

My husband filed both I-130 and I-129f.My I-130 was Nov.2 and I-129f was Nov.17, and both were approved at the same time, this February 16.Now i am on my CR-1 visa.

yes we are married now.. we filed k3 visa which has 2 petitions route we submitted first the I-130 petition then after we got the NOA1 for I-130 we filed the 129F petition ( for already married ) and I have heard the 129f petition for k3 it approves easily compare to the I-130 petition...And we are trying if we can shift to CR-1 visa than K3.

This part of the forum is for K1 visas. You can always report your own post and ask a moderator to route it to the appropriate forum.

Once again, I suggest that you become acquainted with the different types of visas. There seems to be a confusion between the VISA names and purposes, and with the name of the forms that need to be filed for each VISA type.

This part of the forum is for K1 visas. You can always report your own post and ask a moderator to route it to the appropriate forum.

Once again, I suggest that you become acquainted with the different types of visas. There seems to be a confusion between the VISA names and purposes, and with the name of the forms that need to be filed for each VISA type.

i am not confused about the types of visa....Me and my husband knows k1 is for fiance, k3 is for spouse but non imigrant visa, CR-1 is for spouse visa also but it's imigrant entry..I am not confused of the k3 processing also, I knew it how coz we filed already. My question was if it's ok to transfer to CR-1 instead of k3....as simple as that.

I am not sure why nobody is answering your question..... Your 1-129F petition will be closed automatically. You are now applying for the CR-1 visa.
