I really don't want to work illegally..i can't get welfare. Ill see what i can do with the philippine consulate. We are lucky enough to own this house we live in and we only pay for basic utilities.

God help me...

are you catholic? reach out to the catholic church in your area - they can and will help you, get you the resources you need. but you must use a telephone, you must call and ask.

another thought - already mentioned. since you own your house , you should clean it up and rent out a room or two. that'll take care of your utilities and give you some monies for food. you've a computer, so get registered at roommates.com tonight.

Here's a qn though - she's not allowed to work, so she's not allowed to earn income without an EAD... would renting out a room constitute "working" as a landlord? This is income she'd have to declare on taxes... i've personally never rented out a room but I would wonder whether this is allowed either.

I like the idea of selling something either on Craigslist or eBay. A table, a bedstand, books, whatever. Everyone has some sort of things we don't need\don't use that can be useful enough for others to spend money on.

I think it is permitted to generate income from personal projects. She is not permitted to 'work' but a yard sale or something like that doesn't break the law. So long as she is not depriving a resident/citizen of a livelihood, she can generate income. However, she's liable for taxes.

As long as she doesn't cross a certain amount of money here (I really don't remember how much), she can still sell her\her husband's stuff on garage and yard sales.

In TX we sold our old furniture on an "official" citywide garage sale (a lot of sellers, hundreds of customers) and they didn't ever ask for sales permit when we applied. But when I attempted to sell on a street festival, they did, and I ended up getting it and declaring my income.

I am tired and don't really want to search for the link right now, but I am pretty sure I read some sort of explanation about garage sales... I think OP can google it :)

Not so sure. about her being self employed. If her husband owns the house and she rents the room because he is incarcerated, wouldn't he be the legal landlord even in jail? If so this frees her up to do this on her husbands behalf so she can at least survive.

Renting a room in her house would probably be no different from the husband owning a house or condo for rent. The property is generating the income -- not the person that owns the property, I don't see how they can consider owing income producing property as actual labor. Labor exchanged for $$$ = work.

If you decide to rent a room to someone, be very careful and screen them hard. You could seek to rent only to a female, single or with kids -- you are under no obligation to rent to just any warm body that shows up. No single males if you're not comfortable with that. Get references, both personal and employment if you decide to rent your room (s). I'm a landlord, I can help you if you decide to rent a room, there are rules you must follow.

Does your husband own any tools you can sell? Look for other things of value that can be sold quickly, by all means, call the local catholic church and catholic charities for the likely fastest help.

maybe she could make a short term loan on the deed to house and get her aos and aed? could also get a power of atturney from husband to sign his name to things so can get a title loan? and what ever she needs while he is unable to provide for her personly

no. there's joint property laws that apply here, and if she needs wiggle room, then she's acting as the agent of record for her husband, and receives no monies directly.

OP - you need to get a durable power of attorney generated this weekend, and have your husband sign it, so that you can act on his behalf and SHOW entites that you are acting on his behalf.
