The odds are small but what if fiancee gave birth with our baby oversea while we are still in K-1 process.

Then you would need a Consular Report of Birth Abroad (CRBA) for your child, and will have to add 1 more to your household size for the I-134.

Since it is the child of a us citizen the child is automatically a us citizen by birth i believe but the birth has to be recorded by the embassy in the country

This isn't necessarily the case for children born to only one U.S. citizen. The U.S. citizen parent would have to meet certain requirements related to physical presence in the U.S., and if an unwed father is the U.S. citizen, you have to have a lot of documentation related to paternity.

If for some reason you can't qualify for a CRBA, you can add a newborn to a mother's petition and seek a K-2 visa. Under the Child Citizenship Act, once the child becomes a legal permanent resident the child gains U.S. citizenship and can apply for a U.S. passport.

That is a pretty important event and *may* qualify for an expedite. Try your luck.

"What if" this is not the first time such a thing has happened and a search was done to read about other people's actual experiences instead of advice in general. People who have actually been through that particular process are probably going to be able to tell you a lot more.

"Search" really is your best friend here. (We were all new once. The first advice to someone asking a common question should be to search for prior answers and their follow-ups.)

well it may seem suspicious as marriages are not consumated until after the wedding

This is a very blanket, generalizing statement that is not a fact. Yes, there are people who believe in waiting until marriage, but there are plenty of people who don't. This will not look suspicious.

This is not an important event and does not qualify for expedite. You will also need to add another person on your I-134. So if you are earning barely enough then don't have a kid yet...

yea am not saying pre martial sex is a NO NO but having a child in the middle of K1 doesn't seem the best way to go.

It may or may not be "the best way to go" but it happens all the time and there is nothing "suspicious" about it relative to K-1 approval.

There is nothing suspicious about this at all. The OP is probably worried enough as it is without wrongfully being told this is "suspicious". :bonk:

when it comes to immigration matters ANYTHING is suspicious

its not detrimental but its something else that has to be explained

How so? What is there to explain? The CO's don't care if you have had pre-marital sex. And anyhow, the pregnancy has aready happened. Nothing you can do about it now.
