Darnell she can file form I-360 and once approved she can file I-485 form. She will be able to adjust her status based in her Vawa case approval. Self-petitions may be filed while married or divorced, and while living together or separated.

She needs to get some letters from friends/family stating she was suffering some form of mental and verbal abuse, but the most important thing is to get a report from a psychologist about her mental condition.

Since January 2010 I helped (pro bono services) twelve members of the visa journey file for Vawa(I-360), seven of them got their green card already,and five others got the "prima facie determination" and soon their petitions will be adjudicated. It's very important to have a non profit organization or attorney helping with Vawa cases,specially in cases of emotional/mental abuse.

Hi, I went to court on 18th, i didn't have a chance to talk much, i didn't even show my hospital records, but i got restraining order for 1 year. He was there too, he was talking talking talking, telling a lot of lies on me. However i got it. Then i went to immigr. office and got free attorney to help me with immigr. problem. They said it's actually pretty typical when abuser calles the police first so they will be able to explane it. Also they will help me with my other stuff, like divorce, hearings for spousal and child support. I got som welfare money too, they will pay me some food stamps and some cash. They also will go after him to make him pay them back that money, caz we married. Ok now im printing my pictures with my husband together to proofe we were in love.

You better check with your bank about adding your name on his account. I was able to add my name to my Sponsor's account before I applied for AOS. SO, please check with your bank!

My husband is in the MILITARY. I was able to have a joint account with him at USAA Bank. I suggest you check on changing banks or opening up an account with them.

HOW DOES HIS OFFICE NOT KNOW YOU ARE STILL MARRIED? AREN'T YOU RECEIVING BAH???

I have a friend in a similar situation. MY friend's husband refused to sponsor her. i don't know your situation, but this is a way for him to controll her. If your in a similar situation, get a free consultation from an attorney. Know ur rights!

Well he works at Public Affair office so he knows how to say right words to the right person, so he is very tricky, he put me in jail twice already every time after I tried to do something on my own, he also has money, lawyers around, a car and ability to do anything. And I can't even walk out of the door, because I have my baby in my hands, don't have a car or money to get anywhere. So even if I start something he will just put me in jail like always. And as I said his English is much better than mine so he will find a way to trick people to believe him. No lawyer could help me since I'm here so I decided to just deal with him by myself, just be nice to him and pretend that I'm happy with everything. At least he won't take my son from me.. I don't know. It's really risky to do anything.

HE CAN NEVER TAKE YOUR SON FROM YOU!!! This is the same thing my friend's husband threaten her with. THAT IS KIDNAPPING! You notify the MP'S, his chain of command, and the local police if that did happen! He could jeopardize his career in the army. Please don't think your husband has any sort of power of your because of his "money" and "lawyers" or his fluent English!

I really love how everyone here has tried and convicted this guy with only hearing one side, and to be quite frank, her story sounds ridiculous and unbelievable. This guy is putting his life on the line for your freedom such as being able to post on boards etc etc etc , he at least deserves his say. He doesn't deserve to be labeled a woman abuser until all the facts come out. Horrible !!!!

I agree there is two sides to a story. everyone deserves a say, regardless if they have served or not!

To the amazing OP! This whole story is incredible! I wish I had seen it long ago to help you knock back the skeptics. I knew from the very first pages you were telling the truth. People learn in different ways, some by hearing and speaking but others by reading and writing. I am like you in being better in learning how to read and write a language than by hearing and speaking. I also knew you were really Russian by some of the ways you said things, the grammar was so similar to how my Russian wife speaks.

I am so glad things are going better for you now! You are getting a lot of really good advice on here now. Your VAWA petition really is very important! Your shelter lawyer might not know immigration issues as well as you need so be sure to keep reading here and asking questions. Some members here do happen to be very knowledgable attorneys! Keep posting here if you can. You have many friends here who are thinking of you and hoping everything goes well for you!

Sandraj - thanks so much for this !!! I feel less worried about her ability to adjust her status, now... My prior comment was for trying to adjust WITHOUT utilising VAWA.. (ie - it just isn't done)

WOW, I should have read the post in the end! That is great that u did this for yourself and ur son! People are here for u. ur husband can't get away with his abuse.my prayers are with u.

This sounds like thing are really going your way... And with everything you've gone through and endured, you deserve it.. This is the kind of justice that makes all of us proud of the system..

You've come a long way since the start of this thread,, This thread should be an example of a success story.. It should be pinned.. Keep us informed...

Not that it's any consolation, but this could make an excelent story for women who are involved in the same situation and too afraid to do anything as well as those who have gone through and looking for a support group...

I hope your spouse get's what he deserves.. Anyone who can treat a vulnerble person like he treated you, should be dealt with severly.. Let us know how the VAWA case proceeds...

Hi, just updating. I keep seeing a therapist and she already gave me a support letter for my VAWA petition. On 17th we had a mediation. It was about custody and visitations. He askes for over nightes , I said no. But the judge will decide. He saw our son just once since we in a shelter. It was supervised. I think it went well. I also got my son's actual birth certificate (weird, we never had it). Me and my son are still in the shelter waiting for opening in some transitional housing. I also got a letter from navy , that's from my case manager, he askes me to write a statement about all insidents that happened with my husband, describe all abuse that I suffered. Then the commission with different people (including the command or his represantative) will vote for the decicion of how bad the abuse was and what is the safety plan for me.

I am so glad you are doing well.Write down every single details of the mental abuse he inflicted you, EVERYTHING...tell his command and tell immigrations as well how bad was the conditions that you were living in your house, send them some pictures as well,inform them he didn't even provide before your son's birth certificate, tell them he never applied for your adjustment of status etc..YOUR are a determined woman and you will succeed my dear.I am always here if you need me.
