F1 with SSN Marrying a US Citizen

Hi,

Previously- I was on a B1/B2 Visa and got an admission while I was here visiting my family. Changed my status to F-1, Started school like 3 years ago.

My Current Situation- I am an International Student (F1), I currently work on-campus(that's how I got my SSN). Planning to get married in July,2012.

My Question

1) What all do I need to file (I am sorry if this sounds dumb)

2) Will there be only an adjustment made to my status? I mean I already have a SSN?

3) Anything I should prepare for as of now?

You time is greatly appreciated!

You have to apply to adjust your status. You will be eligible to become a legal permanent resident. Look above and click on the "Guides" button, and read I-130 Petition and Adjustment of Status Guide: http://www.visajourney.com/content/i130guide2

SSN is not relevant to this process, as it confers no immigration benefits. You need to become an LPR in order to stay and work in the U.S. indefinitely.

You need to file I-130 and I-485 concurrently. You need to have a civil surgeon do a medical for form I-693 . You also need I-864 showing your spouse and/or joint sponsor can support you financially. And file for work authorization and advance parole for traveling if you need to leave the country while you wait for your petition to be processed. Oh and you'll need $$ for all of this! Read the guides, ask questions when in doubt, and good luck!

Yeah, fill I765 also., it will allow you work legally till you get your LPR approved. Once you are a LPR, I765 is not required.

You do not need a EAD once you get the green card as the latter itself authorizes you to work. You will be asked to surrender your EAD during your AOS interview. If you have already filed the I 485 and received your NOA1, then you can send in your I 765 separately, citing your NOA1 receipt number and ask them to sync it up with your I 485 as concurrent application. You do not need to pay anything extra for this. If you have not received your NOA1, please do not send in your I 765 until you receive it. Your EAD will be adjudged much before your AOS interview.

Day 36,April 25, 2012 : Biometrics Completed at Elizabeth, NJ.

Day 45,May 04, 2012 : E-mail notification for interview received for June 11

Day 46,May 05, 2012 : Received hard copy of interview notice

Day 56,May 16, 2012 : EAD/AP Production e-mail

Day 64,May 24, 2012 : EAD/AP Card in hand

Day 83,June 11,2012 : Interview. Approved same day. Card production email.

Day 84,June 12,2012 : E-mail Notification registering PR status.

Day 87,June 15,2012 : USPS picks up GC from USCIS.

I have a relative Question :

I am also an international student,recently got hitched to a US citizen (July 24th) and we just received our marriage certificate. We are in the process of applying for I 30 and I485.

My Concern -I will be eligible for in-state tuition(which is roughly $2000) if I submit my I-797(receipt of I 130) before September 12th 2012; if not, I will have to pay international student fee of $7000 (which is a lot and killing!) Can I start the process by just sending the I 130 package(without I 485) so i can hopefully get my I 797 and I can submit it at my school? I will file I 485 once my medical check up and all are done(which might take a week or so because we are in the process of moving from Dallas to Houston).

Are there any minimum documents/forms that I can submit with I485 if I do it concurrently with I 130.

I am planning to send my I 130 by Monday August 13th.

Please advice!

You can send the I-130 alone, but it won't give you legal status in the US and sending the forms separately usually just delays the overall process. Are you sure your school only requires the NOA for the I-130 for you to qualify for in-state tuition rates..? Most schools require you to live in the state as a permanent resident for a certain period of time (6 months or a year usually), before you qualify.

You shouldn't send the I-485 as incomplete - I would say the better option is to send the I-130 alone, and then send the I-485 as soon as possible, with all the necessary documents. When you send it, you attach the NOA for the I-130 to make the case concurrent at USCIS.
