I-693 - Surgeons insist on doing the not-needed physical

We're filling out the I-693 to file for AOS, and I'm having a hell of a time finding a civil surgeon who doesn't insist on performing the physical. I've gotten a whole range of responses from doctors' offices, from "we need a letter from USCIS stating what needs to be done"(?) to "the physician won't put her license on the line by signing off on an overseas physical."

The application instructions (page 4) clearly state that we don't have to have the physical done, since her physical was performed in January of '12. Is there any way I can demonstrate to them that they can do it without doing the physical? Do I just have to keep calling until I find a doctor that will do the physical?

What proof do you have that it was done? I don't know about the K1 process, but page 4 of the I-693 talks about a DS3025. Do you have that as proof? If she had an independent check up which was not immigration based, she will need to have one done for that purpose. You cannot just transfer her annual checkup from her regular PCP. Everything must be done by a civil surgeon.

It is understandable that the physician will not put her stamp to another physician's physical. It's putting her stamp to someone else's work that they don't know and even if they do, that physician should put their own license there.They can only put their license to the work they do. Are you adding vaccinations? What is it exactly that you want the civil surgeon to do? Approve the oversees doctor's work with their license? That's extremely dangerous. Extremely dangerous. That's fraud and could mean losing their licence to practice; they will not risk that.

Include the DS3025 with the I-693 and if immigration needs additional vaccinations they will send a RFE with the required vaccinations. You can use that to get the tests done without the physical. I think that's what the doctors mean when they state that you need to have a letter from USCIS stating that you do not require the complete physical but only the vaccinations in the letter. I'm trying my best to help here.

Many of the civil surgeons insist on the physical anyway. Mostly because they can. They do not have to abide by what the instructions say and can charge you anything they like. Nice, huh?

The one that asked for a letter from USCIS? Take them the printed out instructions from the I-485 and I-693 that state a K-1 does not need to have another medical if it is within the year of filing for AOS.

You may need to call some others that are farther away from you. We drove 2 hours to another town to find one that would not insist on another medical or charge us for one anyway. Some people just give in and do what the CS asks for and pay the high prices to get it over with.
