Hello,

Bad news today.

They send me my all package back, rejection notice.

I just called and they told me that is because I didn't put the notice of action of my pending I 130 which I never received. it got lost. So they told me to send am explanation letter that it got lost, a copy of the post office delivery confirmation, a copy of form I 797 C notice of action and a print out of my case status.

I did all that and they rejected it.

Now they telling me to filled I 824 to request a duplicate and to pay 405$ fee.

Any help?

Okay, so you sent a stand-alone I-485 without the NOA1 from the I-130??? The NOA1 is lost?

Why wasn't this covered before in this thread? We could have told you it would be rejected...

I think I mentioned it.

Plus they told me to send a print out of the case status and a letter of explanation, and a copy of the post office delivery and a copy of form I 797 C ( cause I filled extra form!)

Can't they see that I have a pending I 130.

So now what can I do?

What exactly did you send the first time to show you have a pending I-130?

No, they process cases by numbers, not names. They can't see you have a case (or perhaps they can, but they by law won't process it without you furnishing the proof).

I send:

Print out of case status with case number

Post office delivery confirmation

Copy form I 797 C NOA

Letter explaining I never received the NOA

That is what they told me to do over the phone.

Because I send I 130 and I 129 F together and they rejected that I 129 f form and the fee that was with it.

Oh okay. I don't think sending a failed attempt at sending a I-129F is going to help prove anything, so I'd leave that out.

I don't know what to tell you... you could try again, knowing the worst is rejection.

You could wait until the I-130 is approved and then send in the copy of approval notice with the I-485.

Otherwise, I have no other ideas... Hopefully someone with another idea comes along

Ok, thank you soo much for your advise.

I am going tomorrow for an info pass to see what they say and tomorrow morning I will have my husband call again to see if he get luckier that me!!

How long would it take to get my I 130 approved?

Hello,

So finally I resubmitted the all case with a big letter explaining that I have a pending I 130, copy of my case status on line and copy of my all I 130 package,I hope this time they will take it.

They advise me to do like that at the info pass and when I called USCIS this morning.

Now the wait is back on.
