Well the thing is that he started to work here in January and he is on a hourly rate so it depends how many hours he work each week and if the is overtime or not so it is difficult for me to evaluate how much he would be making at the end of this year, do I have to put an estimation?? And he will also get a raise next month, do I calculate that as well?

Yes, estimate and yes,if its a known raise that should be included. BUT you want that information to come from his employer. Him stating that himself has limited credibility.

so can you get them to write a letter saying something like:

xyz is a fulltime employee since 01/02/1234. he currently works for $10/hr. His position guarantees x hours per week/month.

starting 05/06/7891 his hourly rate will increase to $20/hr.

maybe you can get them to add that he usually works x hrs overtime as well.

you can then do the maths and enter an annual figure for 2012.

I guess he would have to contact IRS to find out what we can do now......

i would recommend a tax person first. not sure HR block can help but worth a try.

i do not know what kind of act "not paying taxes is". i am not calling it a crime, i frankly dont know.

but for comparison sake, if you commit something unlawful you should go to the police and own up but it certainly helps to talk to a lawyer first... (late penalties can be 5-25% of the tax + interest etc.)

Each time he is paid, he probably gets a pay stub showing his year to date gross income. To calculate "current income" use this example. If paid every week, divide the gross income by the number of weeks he's been paid for up to now, this year, then multiply that number by 52 weeks. So say 10,000 income divided by 20 weeks is 500 a week times 52 weeks in a year is $26,000. Use your own numbers. If paid every two weeks divide by 10 or whatever the correct number is and then multiply by 26.

they say you do not need to apply for advance parole if both conditions described below in A and B are met:

For A I think I am a K-3 spouse of a US citizen

For B I will have a pending I 485

Is that correct, can I go back to France this year on vacation after fingerprints, of course

You are not a K3 spouse. You DO need the I-131.

You say you entered on a tourist visa, assuming VWP?

have you overstayed it yet? (ie when did you enter?)

advance parole 131 only works if you overstay <180 days. (that is between expiry of visa and acknowledged filing date by USCIS)

Hello,

I need some info or help.

You can see my time in my signature, so I called yesterday because my check is still not cashed and no text and no e notification. So I am now worried.

The lady was very nice and she told me that I am not in the system for my application for AOS. So she said to send and email to the lockbox with my tracking number from the post office which I did. And she advise me to wait about 1 week to get an answer about that email....

Is any one been in this situation? Is this very unusual? Something wrong with my files? Is it going to delay the whole thing?

Any help would be hugely appreciated..
