Hello,

I don't find any similar cases to mine.

I lived in Boston for a few years and had a temporary green card, then I went back home, I am French, had 2 kids and now I am back here. After 7 years so of course loose that green card. Actually I gave it back at the American ambassy in France to be in order.

My husband is American and I wanted to do it the right way from aboard but didn't do it :(.

So now I am here in Boston with my americain husband and my two French American kids. I send my I 130 paper at the beginning of this month to the Chicago PO Box, they cash my check.

And now I want make sure I do it right.

Actually my husband went before I arrive and asked at the immigration booth and they told him to have me come as a tourist and then do the papers here. They said that I have to do the I129f form. Does anyone know about my case?

Any help would be greatly appreciate......really especially I cause I need to work.

Your husband didn't get very accurate advice.

Did you also send the required form G-325 with the I-130? It sounds like you may have begun the process where you would have to interview for your visa in France. Was that your intention?

They can send in the I-485 as soon as they get the NOA for the I-130, and make the case concurrent.

Trefletatoo - do you want to wait out the whole process in the US, i.e. are you ready to remain here now permanently? If so, then look at the AOS guide and prepare to send out the I-485 with all the supportive documents as soon as you get the Notice of Action for the I-130 which you already sent out.

If you want to take the IR-2 spousal visa route, then you just go back to France before your authorized stay under the current tourist status expires, and you handle the rest of the process in France, and return to the US once the IR-2 visa is issued.

Thank your your quick response. Yes I send the G325 forms. I don't want go back to France. I am sure they will have me pay again, especially before I 485 was 255 $ and now it is 1070 $ :(

What about the I 129 F, I am confused why they give him that form to fill out !!,

This form is not used when filing for Adjustment of Status, disregard it.

Follow the guide linked by Ahn Map. Yes, you'll have to pay the I-485 fee and biometrics fee again, and also get the medical exam done. You won't be able to travel internationally or work until you get the AP and EAD documents, which usually arrive within 90 days from filing the paperwork (all of it).

If you already got the NOA for the I-130, then you can submit the I-485 with a copy of the NOA and make your case concurrent. The whole process will take around 4-6 months from when USCIS receives the I-485 with all the necessary supportive documents.

Follow the advise here.

Your husband did not speak with USCIS, he spoke with CBP (customs and border patrol) an entirely different entity who typically have very little knowledge of how the system actually works.

Correct. Soon after filing the I-485, the I-130 will get transferred to MSC to meet up with the I-485. The case will then proceed the same as a concurrent AOS filing.

Just be sure to wait for the NOA from your filing so that you can put the case number on the rest of the submission. Without the case number the documents will never get put into the same file. You won't be sending the rest of the documents to the lockbox, rather you will send them to the service center that is processing your petition.

This is incorrect. You do not send it to a service center. You send it to the lockbox, it goes to MSC, and the I-130 will be sent away from the service center and to MSC. It's all in the instructions.
