Hello,

I'm a little confused as to what to file. I call the helpline, but she told me to file for I-400, but I'm not sure.

Background: I was only 5 when I came to the US so I did enter illegally & my status has remained the same. My husband and I married in December. He is currently deployed and since he gets out of USMC soon after deployment, he wants me to start my legal process.

Will I file for I-400?

Or I-485 & I-130?

Also since deployed, is there any advantage for our case to be expedited?

I'm pretty sure there is no I-400, only a N-400 which would be the application for naturalization. I'm also pretty sure that an illegal alien can't just apply for naturalization.

However I do know that an illegal alien can adjust status as an immediate relative of a citizen so I suggest you start the AOS (adjustment of status) process - I-485 and I-130.

05/2007 - got married in Germany

05/2007 - filed I-130 via DCF in Frankfurt

08/2007 - interview to prove bona fide marriage

09/2007 - hubby PCSed to GA

10/2007 - hubby deployed to Iraq

04/2008 - hubby on RnR in Germany

08/2008 - received CR-1 visa

12/2008 - flew to GA alone to welcome home the hubs

09/2009 - PCSed to CA

03/2010 - we're pregnant!

06/2010 - applied for German "BBG" to retain German citizenship during naturalization

08/2010 - BBG granted

09/2010 - filed ROC

12/2010 - received 10 year GC

12/2010 - our little miracle is born!!!

01/2011 - PCSed to Germany

01/2012 - filed N-400 for overseas naturalization

03-15-2012 - Best of Both Worlds, I'm a dual citizen :-)

Wendy0431, did you enter without inspection? If so, EWI foreigners are not eligible for in-country AOS (in which you file form I-485 along with the I-130 petition), even when they are married to a U.S. citizen. You must go through consular processing, meaning a US consulate in your country of origin, and since you've been unlawfully present in the US for more than 180 days. If eligible, you will require a waiver of inadmissibility during this process.

03/27/2012 - Sent out AOS

04/06/2012 - Received letter for biometrics appointment

04/18/2012 - ASC Appointment done

05/09/2012 - Received e-mail: was mailed I485 appointment notice for an interview

05/11/2012 - NOA received with instructions. Request to appear for initial interview

05/16/2012 - EAD card production ordered

05/26/2012 - EAD card arrived in the mail

06/18/2012 - AOS Interview - Houston, TX... i-130 & i-485 - Approved!!
