Reposting my questions..

Our AOS fee is "in process" now. But I'd like to clarify some points so we could get our AOS packages ready.

1. We only pay once for both mine and my daughter's AOS fee, right? But we have separate barcoded cover pages?

2. We send in a complete package for each of us - so for my AOS package: petitioner's i-864 and supporting docs and co-sponsor's i-864 and supporting docs; and for our daughter's: petitioner's i-864W and supporting docs and co-sponsor's i-864 and supporting docs

3. My husband should fill out an i-864W for our daughter, right? She's his biological child but my husband isn't qualified to pass on citizenship, hence the visa process. But I think she'll become a USC upon entry under the Child Citizenship Act?

Thanks guys. Just want to make sure everything is 10000% correct.

I'll answer this again:

You send in one package for both of you and pay one fee.

I take it your husband is an LPR, there is no US citizenship to pass on to your child. The Child Citizenship Act is only for children of natural born or naturalized US Citizens.

The child must meet the following requirements:

Have at least one American citizen parent by birth or naturalization;

Be under 18 years of age;

Live in the legal and physical custody of the American citizen parent; and

Be admitted as an immigrant for lawful permanent residence.

In addition, if the child is adopted, the adoption must be full and final.

This special program does not apply to alien child admitted as CR/IR-2 when the parents are Permanent Residents

Once either of you Naturalize the child will follow, if they are under the age of 18 and unmarried.

Because the child does not qualify for citizenship you have to file the I-864 NOT the I-864w.

My husband is a US citizen by birth (born in California), but is unable to pass on citizenship because he hasn't met the residency requirements to be able to do so. He was only physically present in the US until 5 months of age, and only returned there September of last year.

By one package, do you mean just one barcoded cover sheet and one copy of all the supporting docs (ITR, W-2, employment letters, pay stubs) of both my husband and our co-sponsor?
