Visa Processing Time Changes

My fiance and I received the NOA1 for January 31. At that time, the processing times at the Vermont Service Center (where our petition is being processed) were 5 months. As of April 23, the processing time for the VSC is now 8.7 months. Does this mean our processing time starts over as of April 23 and it'll now be approximately 9 months for an adjudication on our case? Are we grandfathered into the 5 month processing time period? Does anyone have any insight into how this works for cases that are actually in review when the processing time changes like this? Thanks for your help!

  • Jan 31st, 2012 - NOA1 Received
  • Jul 11th, 2012 - NOA2 Received
  • Jul 17th, 2012 - Received at NVC/Case Number Assigned
  • Jul 19th, 2012 - Petition Sent to Casablanca Consulate
  • Jul 23rd, 2012 - Petition Received at Casablanca

  • Sept 5th, 2012 - Interview (approved)

  • September 26th - 27th, 2013 - Obtained updated immunization, physical, sealed records from Civil Surgeon
  • October 3rd, 2013 - Immunization records mailed to USCIS Charlotte Office
  • October 8th, 2013 - Immunization records received at USCIS
  • October 29th, 2013 - I-485 Application to adjust status to Marriage Visa approved (no interview)
  • November 7th, 2013 - Restricted Green Card arrived
  • July 31st, 2015 - I-751 Removal of Conditions filed
  • August 3rd, 2015 - Received ROC NOA1
  • August 25th, 2015 - Biometrics appointment completed
  • July 14th, 2016 - Application for 10-year visa approved; new card in production
  • July 22nd, 2016 - 10-year visa received
  • September 6th, 2016 - Filed N-400 petition for naturalization
  • September 9th, 2016 - N-400 petition for naturalization received by USCIS - Texas Lockbox (September 9th priority date)
  • September 16th, 2016 - NOA received for N-400
  • October 7th, 2016 - Biometrics appointment
  • October 25th, 2016 - placed in line to receive naturalization interview date
  • February 27th, 2017 - interview scheduled
  • March 3rd, 2017 - NOA received for interview date
  • April 3rd, 2017 - naturalization interview - PASSED!
  • April 21st, 2017 Oath Ceremony

The intent of ever adjusting processing times for an organization is to one accurately reflect how long it is taking per application or two to deal with a higher volume of workload. Previous processing times were set at 5 months but ours took 7 months. No one in USCIS will tell you if you have been grandfathered or not they will now use the new timeline to set it as a guideline of when you can do an inquiry on your visa petition. Effective the new date they have a new processing time best bet is to call and ask.

Moved from IR-1/CR-1 Process & Procedures to USCIS Service Centers forum; topic pertains to processing time at VSC which affects all petition types that are sent there from a lockbox facility.

Our journey:

March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

07/09/12 - NVC Casefile Number and IIN Issued.

07/16/12 - Receive and Sent DS-3032 via email.

07/17/12 - Mailed DS-3032 via mail, AOS bill received via email, paid online, Optin email sent.

07/18/12 - Optin accepted and new case number, AOS marked paid, emailed AOS packet.

07/24/12 - Assigned as Agent, IV Fee bill received via email, paid online.

07/25/12 - IV Fee marked paid, emailed IV packet.

07/31/12 - Emailed GZO Supplemental Packet 3.

08/02/12 - Case completed and commenced final review.

I see VSC has changed back to 5 months instead of September 2011.. hopefully thats good news..

i can confirmed that i just visited it. i hope it stays there forever and the process time decrease for future applicants and current filers.

this is a small victory..
