Are you already in the USA?

Ie are you filing for a visa, or for adjustment of status?

If the first, no I-485 needed.

If the latter, you can, but you are not supposed to- it will slow things down.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yup already in the US

Trying to start the filing process so I'm trying to find out if the I-130 can be filed along... After its approved how long can u wait to file I-485 and I-765. What are the set back to filing the I-130 by itself and what is issued when the I-130 is approved?

The real question is why would you want to? The I-130 does not give you any status....

July 2005 - met my awesome, hot, amazing love in Lousiana.
July 2006 - Married said love and moved to Canada.
June 2011 - Entered US to visit family, decided to stay.
Feb. 2012 - Sent paperwork to Chicago.

May 2012 - Received green card.

I don't know as much as the other people on this forum, but I can't see why you want to do it that way. It will take longer, you might as well just wait until you're prepared to file the I-485 and file it all at the same time. I don't see a benefit to filing it separately.

Personally, I'd be scared to be on the USCIS radar until I was ready to do the entire process. But I'm a little paranoid...

5/21/2012 - Email/text notifications received at 4:50 p.m.

5/26/2012 - NOA hard copies received for I-130, I-485 and I-765

6/19/2012 - Biometrics completed.

7/02/2012 - Text/email/hard copy notification of interview.

7/30/2012 - EAD card production ordered.

8/02/2012 - Interview @ 2:00

8/02/2012 - Email notification of GC production at 5:30pm

8/07/2012 - Second GC production email

8/07/2012 - EAD received.

8/08/2012 - GC mailed.

8/09/2012 - Welcome letter and I-130 approval letter received.

8/10/2012 - Green card received. :)

I-130 gives no status and filing it alone will only make your case go extremely slow. The whole time the I-130 is processing will be wasted time - once the I-485 is sent in the clock will start over. You will get no "credit" for filing the I-130 first. So you are proposing to waste over a year on a process that can be done in a few months. Why?

To answer your question, NOTHING is issued when the I-130 is approved. It gives you no status, no protection, no nothing. it is a bureaucratic process that shows you have a familial relationship, which gives you zero anything.
