Living in the US whilst awaiting processing

be back here in Australia when the application is being processed?? Is it because I would be receiving my notification at my Australian address?

If you can afford to stay in the US during the 5-6 months it takes to process the K-1 and can fly in and out as many times as I want - would I be able to stay in the US during those long 5-6 months? I mean if I get my notification it would

ony be a matter of booking a flight and getting back with 24-48 hours to deal with it. What I am asking it is - are there any RULES regarding this period.

Finally, I-134 Affidavit of Support form - I am a woman and I know 99% of the time, the person residing in the US has to prove he or she can support their alien spouse. What about if I am more money and assets than my man. How does this form work then?

If I have a home in the US and and in Australia?

It's recommended your fiance has a copy of the full package so they can review it before interview, and bring it to interview- embassies have been known to loose bits of the package, so it is good to have a copy to give them if necessary.

The visiting rules during the K1 processing are the same as for normal visitors- ie if you are on the Visa Waiver, you can stay a maximum of 90 days at the time, and the guideliens are to stay outside the USA longer than you were inside.

The affidavit of support applies the same whether you are a man or a woman. The petitioner must have the income or assets, it doesn't matter if the foreign fiance has more, as long as the petitioner has sufficient to make the 125% poverty line.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
