How long for LPR to bring children?

The US citizen stepfather petitioning for the children is the quickest way to bring them to the US. As long as the child was under age 18 when the marriage to mom occurred, he can petition for them. He does not need to adopt them. Adoption is not a requirement for him to petition the children. He can file today!!!!! He meets the single requirement (stepparent/stepchild before age 18) to be able to petition for them. This is by far the best and quickest way for the children to immigrate to the US.

The second quickest way for them to immigrate to the US is through mom. If she files now as an LPR, she can upgrade the petitions when she becomes a US citizen. This is the second best choice.

Any other alternative will take longer so I will not discuss them.

It is true that this is the fastest way to get the petition filed. However I would suggest begining with obtaining the bio fathers permission in writing according to the embassies requirements, whatever they are for Brazil. Hopefully that will not be too difficult but the fact that they live with the grandparents should indicate something.

Just want to add on to the other's replies. I came to US 4 years ago, married my USC husband, my son stayed behind with his dad in Brazil. Time came when we decided that he should move to US. My USC husband petitioned for him ( I-130) and the process went VERY smoothly. It took almost a year, but it could have been shorter than that, as it took a while for me to get aquainted with this type of process. All in all it was indeed super-fast and easy. :thumbs:

He is 16 now, and just moved in with us, going to school, making new friends and everything is going great.

Wish the best for your friend - and I would suggest she joins VJ as this is the best source of info, help and support needed in this journey. :yes:

What if I petition my parents to come here in the USA by next year, possibly they will become LPR. Once LPR, they would like to petition my 17 year old sister. Can they petition right away? or wait couple years to file a petition? I would like to know ow many years exactly theey have to wait in order to bring their under 21 child in the US?

I would have them petition right away, my mom came in February 2009, she didnt apply for my sister until March 2010, we are hoping to get an interview this August 2012. But who knows maybe if we would have applied right away in 2009 we could have received an interview before the retrogression or at least by now. Also, her being 17 is important that you file right away!!!. My sister is 18 now, was 16 when we applied. Good Luck.

Children of LPRs (under 21) are about 2.5 years right now, but that could always change. So if your mother files immediately you're looking at 2.5 years from when she files. If you haven't petitioned your parents yet, that will take close to a year so you're then looking at 3.5 years total for your sister. I would start the process soon if possible, because once your sister ages out the wait is much, much longer.

Yup. It starts with an I-130 petition filed for each child.

Once approved, there's stuff to do at NVC for each immigrant visa application

In the end, there's an Immigrant Visa interview for each of them, and

(I THINK) the visa status on each child will be IR-2.

So, back at the OP, tell yer friend to get busy with the I-130 petitions this weekend. We've a guide for that, here at VJ, also.
