Hey VJ!

First of all, thanks for being a great resource regarding immigration issues. It's been a huge help over the entire process.

Long story short, I'm married to a Vietnamese national. I petitioned for her I-130 on September 2011 and received my NOA1 on September 9th, 2011. We passed the 5 month mark months ago and I understand that the CSC was back-logged for awhile. I've seen that they are back on track and are approving petitions at a normal rate once more, however, mine has seem to have been put on the back burner. I've done everything under the sun to get this process sped up but no avail. It's maddening being away from my wife for so long and the distance has taken its toll. Now my Congressman emailed me this afternoon stating that the application is still under initial review. I’m just curious if there's anyone else still waiting for their NOA2 that filed in September. I'm seeing approvals for October and November left and right. Could there be some kind of issue that I'm not aware of? When I called USCIS on Friday, the rep I spoke to put in a SR and said hang tight for two weeks. When I asked to be transferred to Tier 2 she said they were not available for the next 3 to 4 hours which I think was untrue but who knows...

We're still waiting with a priority date of August 31, 2011.

Our case is a bit out of the ordinary though.

I know the feeling.. our petition is K1 though, but got approved after 8 months and 5 days. (VSC) i hope you get yours approved soon!

July 09 2011- form I-129f sent by mail.

July 12 2001-received by the USCIS Dallas,got an email,forwarded to Vermont service center.

July 15 2011- NOA1 received. (I-797C)

July 20 2011- touched

March 16 2012- NOA2 Approved.(no RFE,crazy huh?)

March 21 2012- NOA2 (Hardcopy)

March 21 2012- Case# assigned. petition forwarded to US EMBASSY MANILA

April 2 2012- eligibility letter received.

April 17 2012-Medical appointment-PASSED!

April 27 2012- Interview PASSED!

MAY 10 2012- VISA ISSUED

MAY 26- POE-(DTW) (to ORF)

June 10 2012- WEDDING! :)

July 24 2012- AOS sent

August 1 2012 - NOA1 received by text

August 4 2012 - biometrics appointment letter received

August 9,2012 -Biometrics done!

September 27,2012-EAD & AP approved!

Our petition took 260 days (8 1/2 months) with no RFEs. (June-March) Since it's been 7 months it probably wouldn't hurt to write your congressman or senator and have them look into your case and find out what's going on.

I've actually done both at this point. My congressman informed me today that the application is still being reviewed by an adjudicator. He also mentioned that his liaison over at the CSC is also going to contact the officer to see if there's anyway to speed up the process. Thanks for the advice!

Wow..8 months..I totally understand, we are coming up to our 6 month mark come May 8th, we filed november 8, 2011, and I too have seen so many november and even some december filers being approved..but with that said, hang in there...I hope that we all who have been waiting 6 months+ will get an answer, or even better, an APPROVAL!! I contacted our congressmans office and spoke to his aide that deals directly with the service centers processing petitions and she was told that an officer has our case, and she went on to say how each officer has an overwhelming workload of petitions to review and that is could be in their cubbies awhile before it's actually reviewed...the news was a bit promising, but still kept me wondering, when? when? when? but in your case, I definitely would contact your congressman and really ask what is going on? hope you get an answer soon..good luck

It's been about 7 1/2 months for me. I contacted USCIS for the third time last week and they finally put in a service request for me since they said I was now "67" or so days over the average time... Hope we hear back very soon and you too on your case. :)
