My husband filed for the I 130 in January and we sent the I485 in April.I attached the I 130 receipt notice and my priority date is January 23,2012.Since my case is now concurrent,which I believe means that my petitions are combined together as if I filed them at once,why would I have to wait an additional 4-6 months till the process concludes? I know they are separate petitions,but doesn't having a priority date of jan 23,2012(the date my I 130 was filed) mean that my case is now concurrent? And doesn't concurrent mean I filed everything together ?

You have to wait 4-6 months..lthats how long it takes to process an I-485.

July 2005 - met my awesome, hot, amazing love in Lousiana.
July 2006 - Married said love and moved to Canada.
June 2011 - Entered US to visit family, decided to stay.
Feb. 2012 - Sent paperwork to Chicago.

May 2012 - Received green card.

Concurrent means they are together - now. If they have indeed already been put together; they may still be separated at this point. But as was mentioned before, the I-485 alone has 4-6 months of processing time. That starts the day it is received, regardless of what else was filed.

You did it the "wrong" way originally - "wrong" meaning that "concurrent filing" means that usually, the I-130 and I-485 are submitted together from the get-go. The I-130 only establishes that the foreigner is eligible for a GC because of the marriage to a US citizen - the rest of the process is all dependent on the I-485. The fact that you sent out the I-130 separately has no bearing on the processing time of the I-485, as has been noted by several other people already.

Processing forms takes time. The I-485 takes 4-6mths. It is this application that gives you AOS, not I-130. They don't take the application, put it on a shelf and 4-6mths later do everything and send you an interview. The process starts when they receive the application and keeps going until you are approved or denied this takes time. 4-6mths is a good average. Some a little sooner, some a little longer.

You are looking at it just a bit off...

Look at it this way.

Say you filed seperately and waited for your I-130 to be processed before filing I-485. That could take you till June-July, and then you file the I-485...you could be as late as next January before having that go through

Doing it as you have, you may very well have shaved a couple months off. Given a late April filing you could be anywhere from August to October depending on your location.

That's a heck of a lot better than January, isn't it?

Because otherwise you would wait however long the I-130 takes to be approved (6 months or so), THEN submit the I-485 and wait ANOTHER 4-6 months. So about a year total. By now submitting the I-485 and making them concurrent you have only wasted 3 months waiting on the I-130 and now will be processed in the normal 4-6 months. So your total time will be 7-9 months instead of a year or more. So you DID speed up your process by filing the I-485 now but it won't be as quick as had you followed the directions from the start. Your January priority date is ONLY for your I-130 so at most that could be approved quicker but the I-130 is not your petition and gives you NO legal standing or authorization.

I have a much better understanding now.Thanks for the clarification.And yes,Aug-Oct. is much better than waiting till January.I hope to return to school soon and I am waiting on the greencard to do so,because I will need to apply for financial aid.I will miss the deadline to apply for next spring semester which is September 15th.I guess I should plan to go back next fall instead.I can't wait! I'll try my best to chillax during the AOS process :D

I don't think I ever need to ask this question again :P It wasn't about not following directions.I didn't have all of the money for the AOS ,but I had enough for the I130.I didn't want to spend it so I went ahead and sent it.I had all of the money for the whole package before and I had to use it for an emergency.I didn't want the same thing to happen.Plus,when I read that I could make my case concurrent,I thought it would take 4-6 months from the time I sent the I130 to have the AOS petition approved.I know,thinking that doesn't make sense because they're two separate petitions...But thanks to you and some other members for clarifying !Now,I shall wait !
