Hi there,

I just found this great forum and was hoping to get some much needed help!

ok so here goes....

Im a UK citizen and have recently married my husband who is a US citizen, we met over here in the UK and married in march, unfortunately before i met my husband he was already an overstayer we have looked into adjusting his status here but the time and money to do so is pointless as where we really want to live is back in America with his family.

so i guess my primary question is, would it be legal for him to fill out the I-130 form over here to initate the process and mail it to his mum's address in seattle, the one where we would eventually stay with so she can include the check and mail it to the correct lockbox as he cannot file it over here because he does not have permanent residency?

secondly if she is able to do so can we do the same with the K3 visa?

our main concern is that we do not want to spend any significant time apart, the heartbreak of not being able to live together would be too much.so if we are unable to do the above what would be our options?
