Marriage fraud victim asking for advice..

Whatever i just wrote is totally True. Marriages in 3rd world countries are not traceable, if they are not court registered marriages. However, there is this document, called 'Nikah Nama', that contains signatures and all details of the bride and groom.

Now i know, what to do.

Better have proof of the unregistered marriage or they can just consider it hearsay. You need proof such as the unoffical document you mentioned. Do you have a copy of it. What other proof do you have that would be recognized other than your word. Ou would need factual information as evidence, not hearsay I would believe.

If you do have evidence and they do deport her, then to my understanding if the the baby is born in the U.S., then it would be a USC you would probably retain coustody. A lawyer could help you with that for sure. Also never apply for a US passport if the baby is born here. She can't take it out of the U.S. without a passport which requires your signatre as the USC for approval. If she leaves the country to have it at home, then there probably isn't much you can do especially if she leaves it with her family and returns to the U.S. in a timely manner so they won't revoke her GC. Not when fraud is involved. She defrauded him and left hm so there will not be both parents for right now and she is alleged to have been married already before the K1 to another man in her country. Big time fraud if it can be proven. If she leaves the country to have the baby and then come back without it and leaves it with her family, then he does have a leg to stand on. It would not be a USC. If he reports her for marriage fraud and has proof to give to the USCIS/ICE and she isn't deported until she gives birth to the baby, it will be a USC and will need a passport, which requires the USC to obtain it.

Who is to say she didnt get a divorce. From a quick search, it turns out:

Marriage in Islam is a contract with the standard elements of offer, acceptance and consideration, and not regarded as sacrosanct. It may be terminated by divorce subject to certain conditions, although Hadith state divorce should only be resorted to when there is no chance of reconciliation. Divorce may be instituted unilaterally by the husband by pronouncing talaq, "I divorce you" three times. There are many Hadiths requiring that talaq is not uttered sequentially three times but separated by a month between each utterance to provide opportunity for reconciliation. Majority of Islamic schools of jurisprudence (fiqh), do not regard a divorce as valid if this requirement is not followed, however others such as Hanafi discourage such practice but accept as binding if a triple talaq is said sequentially at one time.

well i see even in movies that some muslim ppl divorce just by saying talak 3 times so i inquired from learned members from the mosque and they laugh at me. They never really answer me how exactly they divorce but its my understanding that saying talak 3 times might break the religious bond of marriage but the actual legal part should still be valid??? maybe someone will clarify the exact nature of muslim divorce

It's not a legal divorce.It's only said if the husband means it and does the legal action of the words.But when he says I divorce you 3 times than it's only in front of GOD.So in GOD'S eyes your divorced.I just asked my husband about it :lol:

Agreed to an extent. But reporting marriage fraud isn't just about "hatred" but about reporting a crime. If your wife robbed a bank, you'd still be obligated to report her if you knew.

When it's actually you that's being "robbed", I'd say even more so.

No, they really don't. Children need good, loving supportive people in their life to grow into well rounded individuals. Living in a conflicted household can emotionally cripple a child and result in anger issues, self-esteem issues and all sorts of other problems. Are you saying that by simply spawning a child that person MUST be in said child's life? Or are you saying that at least a male and female parent must be in the child's life because a biological connection does not a parent make. Also, by your logic if a parent passes away the surviving parent must IMMEDIATELY find a replacement parent because only one parent is bad for the child.It's a complete fallacy that children raised by single parents are less well-off by only having one parent. It depends ENTIRELY on the type of parent/s and the situation the child grows up in (including school and peer group).

I totally agree with what everyone else says, contact ICE and USCIS about the matter. These are the type of people who make it hard for actual couples who are really in love and want to be together.

Feb 2010 - Relationship Became official

July 1st 2010 - Came to America to meet Her and stayed 30 days.

November 4, 2010 - Bought her a ticket to come see my country

December 1, 2010 - Came back to america to be with her for 3 months

March 10, 2011 - Took her back to Jamaica with me and she returned home after 5 days.
