Am i eligible to apply for N-400 already?

Hi,

My husband and i got married Feb 2009 and i had my conditional PR the same year and got my 10yr PR last year.

Here's the details of my PR card:

Resident since: 08/14/09

Card expires: 08/31/21

Category: IR6

Does this mean by 08/14/12, i can apply for US citizenship already?

You can actually send your application 90 days before this date, as long as your husband is a US Citizen. If my calculations are correct, you can send it on 5/16/2012. With that being said, I would suggest you wait 2 weeks more, because I have read stories that the interviews were originally scheduled before the anniversary and the applicants had to be rescheduled for another day, after the anniversary.

Yes - you can actually submit your application 90 days before 08/14/12.

Based on the info you provided, you can send your N-400 on May 16, 2012.

thanks guys. i just wanted to make sure because someone told me i cant apply til im a PR for 5 years so thats means 2014. but upon researching i'm seeing it says 3 years in my case since im married to a USC. glad to know its indeed 3 years and that i can start my application already this May

Yes, you are an exception from the 5 year rule, since you're married to an USC (IR6 category on GC is AOS based on marriage). You can apply 90 days short of 3 years. I gave you the exact date
