My mother I-130 not approved till now applied in August!!!

Hi Guys, Hope everyone is doing very well and their I-130 is moving smoothly... I filed for my mother at August last year and till now I did not recieve anything.. NOTHING! I am very furious because I need my mum with me before I start my residency. I see many people had their IR-5 approved already who filed after me and I am really confused I don't know what is going on... I called USCIS and I asked them to check and they found out that my mum case has been out of processing times and I asked to expedite her I-130 and sent them my son's birth certificate and a letter from the hospital where I am going to start my residency in July! and I even scheduled an Info pass and went and there was not anything added to tell me what happened! all the officer said to me at the info pass that she sees that they recieved the document that they asked for to know why I wanna expedite my mum I-130! then 3 days later I got a later and an email stating that I should hear from them in 45 days!!!

Now what shall I do? should I contact my senator? I am very frustrated :((

Thats strange especially since you are petitioning for a parent. When I read your topic i thought maybe it was not received by them but now from your details I see they actually acknowledged they received it. by now you should have been talking of or done with interview already. Anyway give them a week or so and contact USCIS again.

You did not receive "NOTHING!" You got a NOA1 on August 22, 2011.

The processing time for your mother is normal. USCIS has a goal to process in 5 months. However, it is only a goal and not a promise. Some cases take longer than others. There is no reason for it. Some people work faster than others. Some offices process faster than others. 7 months is normal.

The US government is not going to expedite your mother's case because you need a babysitter before you start your residency. If you need a babysitter to return to work, then you can hire a US babysitter.

The US government advises both the petitioner and beneficiary not to make any plans until the visa is in hand. If you are planning for your mother to immigrate to the US and care for your baby before she gets a visa, then any broken plans because she does not have a visa are your problems and not the fault of the US government.

You need to be more patience. Your mother's case is being processed normally.

Contacting your senator will be useless because your mother's case is being handled normally.

Where do you get off talking to the OP like that? It ain't none of your *BLANK* business if the OP wants his/her mother to be here as a baby sitter. And USCIS is definitely dragging their feet on the OP's case. Eight months is enough time for the OP to be concern and ask for help. Some of you need to have a blog spot going on some other site. People come here to ask for help and have questions answered by others who might have been in the same situation, not to be talk down to by "Dr Phill" There is always a time when we don't have anything to say that would be helpful to a Poster, that's when we must take the time to shut our PIE HOLES.

I'm not sure they will expedite your case for the reason set forth, but you have every reason to be concerned. I understand you have made plans and they're not going your way right, but even this too shall pass, huh. Keep calling USCIS ask to speak to a supervisor. may be they will be able to give you a better understanding of your case. If you want to you can call your senator, they are elected to represent the people of the state. Just be concerned about your case taking longer than six months and not the reason for your anxiety as it wont matter to them. wish you the best. Things will work out, maybe not on your terms but it will.

aaron2020 The USCIS itself told me that my processing time is abnormal because they are now working on cases that was filed in November and I filed in August, and that's why they sent an Inqury and even the Immigration officer at the Info pass agreed that something is wrong!

About brining my mum here for my son and daughter.. My hospital were I will start residency have onsite daycare! But I will have to be oncall for 30 hours every 3 days! and this is not only the reason, I don't believe that some stranger that I pay for money can love my kids as much as I do! and this is something I am sure my mum does. a nanny may put them in bed and bla bla but she can never love them! I wanted my mum because she is the only person in this world who can replace my presence for my kids and give them as much love as I can. That's all! Not to mention she is coming for a GC which she is not taking someone's job! she can work herself. But for her and in our culture at least, it's very very normal for the grandma to take care of and have our kids while we works or go away! I am sorry I can't not trust anyone with my kids! I belive if I can't trust that person with a diamond then I can't for sure trust them with my kids because they are simply more prescious than any diamond in this world for me!

I hope that your congressperson was helpful. What a frustrating experience. I am going to take a deep breath and not feel as worried about it being 3 months into my process. Wish you the best and please advise if the congressperson angle gave you any progress. Cheers!

Keep calling every day until you get a break through. Keep your congressman honest on this as well... Your case has definitely taken too long by dont give up. It will work out in the end. The timing may not work exactly as you had hoped but it will eventually work out. Good luck and please post an update once you have heard something.
