Hey, I',m probably not much use but I can say I have dealt with LAX border control a fair few times whilst visiting my man, and some of them are extremely short-tempered and jumped up - I think he who refused your lady was seriously having a bad day. An American immigration lawyer I think would be your best bet... not a lawyer from S.Korea. x best of luck

Maybe because LAX border control had other things on their minds like all the drugs that were flowing through there right under their noses!!!!!!!!

On a page in between the first and last pages, the OP clarified that she was his fiancee, not his wife and that he simply wrote it wrong in the thread title.

Which would be what I said it was, a lack of attention to detail that would cause concern....on several levels.

Reading this I have lots of questions:

1) if he was waiting at the airport, did they interview him?

2) if they were allowed to see each other, what was going on?

3) did they search her luggage and find something illegal?

4) Did she refer to you as husband instead of fiancee?

5) did she say you were already married instead of the marriage would happen in 90 days?

this is a common trick question of the Officers to catch couples who are married.

6) why did they allow you to exchange weddings bands? this could easily have been viewed as being legally married and fulfilling the K-1 visa requirements. Why were they allowed to see each other, how long were they allowed to see other, what happened in the process when they were togther, how long had he been waiting at the airport

7) ages of the SK and USC?

8) how long was her interview?

9) how long was the process at the airport?

10) Why did they have him buy a ticket back for her? (something sounds wrong here)

Why did he buy the ticket, what caused him to buy the ticket, how quickly did she get on a plane home

11) Did he argue with them, did he intervene on her behalf?

12) Did he do anything to arouse suspicion of their relationship?

13) like others have asked, how do they talk and communicate?

14) why did he not travel with her from SK to take her through customs?

15) was a translator provided or did the IO understand enough Korean and she said something in her native tongue which prompted issues. (she could have said insults about the process or to the IO in being detained, and those insults could have been taken as threats to USA causing the IO to refuse entry.

16) How did they get a k-1? He has no timeline, no information, nothing to help us understand their process.

steps: (there is no magic bullet here to fix the issue. the quickest way is to go to US Embassy in SK for first help.)

I would go to the Embassy in SK and have her Visa checked and re-issued if possible.

If the Embassy in SK re-issues her visa, travel WITH her back to the USA, accompany her through customs. DO NOT GET MARRIED. Make sure she refers to you as FUTURE HUSBAND, make sure she knows wedding date.

if there are issues, with embassy re-issuing K-1, marry and file I-130, ask for an expedite based on process which happened. State her current situation based on the what happened at the airport in refusal for K-1 entry. You may not be granted expedite. but there is no harm in asking.

Best of luck in this. Nothing is easy. And like they say, each step is a hurdle to cross. Until you have the naturalization, anything is possible.

This is unrelated but a few years ago my wife who is from Brazil and I had flown down to Harlingen for 4th of July weekend. We drove over to Progresso TX parked and walked into Nuevo Progresso. Messed around there and ate lunch. On the way back we showed American passports. My wifes Brazilian passport was at home in Houston(no need for it). Got hauled in for secondary discussion which went on a good 30 minutes. Since then we have not crossed a land border into Mexico(not that I would these days). We never got such an interrogation at an airport. I have been hassled less at African land borders than occurred that day.

So they can hassle Americans also.

I believe the poor fiancee was intimidated by the officer.

lol. actually that happens a lot to immigrant women. but let's be serious, no matter how intimidated we are by officers (and i think that happens often) such a small infime percent was refused entry. as darren says there are things that the OP didnt explain or didnt believe they would be red flags. anyway trolling or not is a possibility and all new immigrants should know in advance what to say and what NOT to say

I am one of those K1's that just mailed off my petition. To be honest, this freaks me out a little bit. My fiance and I have talked about it and we were almost in a panic when I first read it. Now not only do we have the worry and stress of just getting to the interview and having the visa approved, we have to worry about actually getting him across the border. I feel very lucky after reading this thread. My wife's POE was Chicago and the multiple times I flew back from being overseas I was harassed and I'm an American Citizen .Her and the kids English were poor at best, glad they didn't interrogate her.

I need some real help. My fiance did not make it past the homeland security screening and was sent back. k-1 was cancelled. Any recommendations for lawyers or what could I do to fix this.

I think that you should get a lawyer--this is too crazy for belief. At this point only a good immigration lawyer can help you to see if you can salvage your current K-1; otherwise, if you must start over then I agree with others, just marry her there and then go through the process of bringing her here.

In my repeated experiences, the CBP agents at Nvo. Progreso are average or very slightly worse than average, among the Texas land POEs. The "least harassing" (to my observation) are in Brownsville (across from Matamoros) & Laredo (across from Nvo. Laredo). The worst have been in Roma (across from Cd. Miguel Aleman) & Eagle Pass (across from Piedras Negras). So, what happened to you (unclear -- was your wife a USC by then? you have no timeline) doesn't broad-brush "all" Texas land POEs, or even Progreso, as places of constant hassle.
So they can hassle Americans also.
You haven't been hassled until you've tried to drive through the internal CBP checkpoint south of Alpine, Texas.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
