Meeting Poverty Guidelines, NEED HELP

Hey guys,

Please, help with advice.

My fiance is US citizen and it is 3 months since our NOA-1. He has tax returns ONLY for 2011 (he didn't file taxes before). Also, he doesn't meet Poverty Guidelines to be a Sponsor.

Our question is: if now he will find a job with enough salary to meet Poverty Guidelines (e.g $18.912 per year)- would it be enough to be a Sponsor and to not involve a Joint Sponsor???

It's up to the consular officer. They have discretion with a K1 visa that they wouldn't have with an immigrant visa. Most consulates do rely pretty heavily on the most recent tax return, but some will cut you some slack if you have a new job that you've held at least three months and can produce an employment letter and pay stubs to prove it.

05/01/2013 - Removal of Conditions - APPROVED!

Kiev goes by CURRENT income. So, YES, if he finds a job before the interview and can verify it and it meets or exceeds the guidelines you are good to go. He only needs ONE year tax return for the visa. For the AOS he will have to explain WHY he did not file the previous years.

Yes it is up to the consular officer. In every case I know of, Kiev allows the use of "current income" in some cases from very recent new jobs. Kiev is not particularly difficult in this area, or has not been to date anyway. In our case they quickly "flipped through" my documentation,(literally flipped through) detached it and kept just the I-134. :blush:

Can vary by consulate. You do not list your country so I cannot comment. I have experience with Kiev.
