Dwheels, see though if they were going to deny you or I after looking at our evidence they would have flat out denied it, i think

You would think so huh. I just wonder with all their note talking at USCIS and NVC when they examine a petition. That all determines what a CO is and isn't going to quiz the Beneficiary about.

I am confident that what I submitted and more importantly what we have lived thus far these 2 years 9 months and 20 days show two people who fell in love got married spend a lot of time living together and now just want to live out the rest of our lives in happy marriage bliss here in the States.

Timeline

it's rare that you can reach a human at the local office,

but

back at the National Office, an ISO (see http://www.dhs.gov/files/publications/gc_1305658440339.shtm )

can tell you what's what.

It's a PITA to get an ISO, as the CSRs, the Tier 1 fellas, 'try to be helpful'.

Call, get an ISO, inquire what's what.

Ask specifically - 'Please read the reason, stored in your computer, why my casefile was transferred to a local USCIS office'.

ya, alas, what yer really chasing after is, 'An answer over the telephone'.

You are NOT seeking a service request. You are NOT attempting to set up an infopass.

Instead, you want the ISO to actually READ the electronic thingie stored in the computer, find the bit about WHY the casefile is being transferred to the local office, and READ THAT BACK TO YOU.

even ISO's are trained to be triggered on buzzwords. So if they hear 'Service Request' from you, most will start the Service Request diatribe, when, in fact, that is NOT WHAT YOU WANT from that telephone call, at all.

I hope you don't get stuck in the same 'local office hell' I'm in. I'm glad that there are stories of people who had good experiences with their local office. No amount of infopass, senator, service requests, etc has helped us.

Our Love will get us through this. It grows stronger everyday.

My husband is in removal proceedings.

We got transferred to our local USCIS (as we knew we would). After not hearing anything for a month, I called a tier 2. They put in a service request. About a week later we got a letter in the mail saying they are processing our case and if we don't hear anything in 6 months, we could call them back.

We are basically just waiting for them to schedule an interview date. Hope it doesn't take 6 months for them to do so. We'll see.

HUSBAND'S CASE

9/17/2011 - sent I-13

09/19/2011 - noa1 received

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

That succcckksss - is he in removal proceedings now? Where is your local office?

I think someone stated earlier you could always make an infopass appt then go in with all proper docs then say "give me an interview now."

He is in removal proceedings now.

We need the I-130 interview (which is what we are waiting for now-just getting it scheduled could take 6 months is what they are saying!!!!). Once we get approved with that then we have to go see an immigration judge and ask him to take us out of removals. If he agrees then we beg him to approve our adjustment of status on the spot. If he does then husband could have green card within a few days. If he doesn't grant it on the spot then we have to send to NVC and go through that process ( filing, waiting, interviews).

I keep saying, at least my husband is here with me. Can't imagine how people with long distance relationships stay sane! We have filed for my stepsons now and it's becoming a real chance that they. Might get their visa before their own dad does!

Info pass sounds interesting. I didn't think they could do anything for us in this situation! Will look into it, thanks!

Oh, and our local USCiS office is Chicago. 7 months later and our petition is back where it started!

I've visited him once since he's been back home in ES. It freaking sucks, especially because we have a 6 month old daughter (he wasn't there to see her birth -- he was in immigration jail).

Hopefully everything works out in your case -- the US sure doesn't make it easy :(

Wow I can't even imagine having a child involved. It must make it 100 times harder. My husband and I are so eager to start a family but I feel like we should wait until this whole process is over then again Idk how long it's going to take and I'm not getting any younger. This whole journey is just a pain :/

He's never been arrested or had a run in with immigration. He has been in constant contact with them since he's been here. They have had every address he's lived at for the past 6 years. They never came after him, as in they have never showed up on his doorstep. But they sent him a letter in October, 2010 stating that he was now in removals. We went to court in Early 2011. The rescheduled another court date for 2013 and here we are.

Wow! I'm sorry that your hubs missed the birth of the baby!

This is for i130, right? This little piece of advice? The ISO wouldn't tell me the reason -- she said "they don't have access to it." .... maybe you were talking about NVC stage? *sigh* I wish I had answers. :crying:
