After K1 marriage/ Spouses Parents and Siblings

So i was talking to my fiance about having her family move to the U.S. after we marry. Just wondering how long that would take before her parents and brother could possibly move to the U.S. Maybe she has to become a citizen first??

Anyone have any experience in this issue?

Yes your wife has o become a U.S. Citizen first. You cannot petition for her family, as they are not your immediate family. If what I have researched is right, your wife is eligible to apply for U.S. Citizenship 3 years after issuance of her green card, as long as she has not lived outsid of the U.S. for an extended period of time while having it. She must be a citizen, though her the parents can come fairly quickly. Siblings range from 10 years after filing to 23 years> Unfortunately your wife comes from the 23 year country, One the parents are here and LPR's they can also file for their children with shorter waits dependant on the siblings ages.

This will not be over quickly. You will not enjoy this.

OK thanks, so how long does it usually take after one applies for citizenship to actually get the citizenship? She gets the green card as soon as she gets here right? Its just temporary for two years from what i understand?

It could take after she gets here and you marry and file AOS, 5 to 8 months before she gets her green card as long as you get no RFE, I have read that they have pushed processing times back. This process or any other is not rushed, we all have to wait, Good Luck

No she won't get the greencard as soon as she gets here. First you have to marry, then file Adjustment of Status; she won;t have her greencard for 5+ months. Once she has it, she will need to apply for the 10 year greencard 2 years minus 90 days later, and she can apply 3 years minus 90 days after the first greencard (so about a year after removal of conditions) for her citizenship. How long that process takes depends on where you live- anything from 6 weeks to almost a year.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It will be a very long time before her parents and brother can immigrate to the US.

You cannot petition for her parents or brother. She can file for them only if she is a US citizen.

Here are a summary of the steps she will need to take to bring them over;

1. K-1 visa for her. (6-12 months)

2. Adjustment of Status for her to acquire legal permanent residency - she gets a conditional green card. (6 months)

3. File to remove the condition on her green card 90 days before the second anniversary of getting her green card. (6 months)

4. File for naturalization (US citizenship) 90 days before her third anniversary of getting her green card. (6-12 months)

5. After 3-4 years after getting her green card, she can file for her parents and brother. Her parents will get green cards in about 6-12 months if they meet all the requirements. Her brother will not be able to immigrate with the parents, there is no mechanism that allows him to immigrate with them. It will take 12-23 years for her brother to immigrate to the US through her.

6. As LPRs, her parents can file for their unmarried son. Depending on his age, it could take 2-3 years if he is under 21 at that time, or over 10 years if he is over 21.
