Hello Everyone

I am US Citizen and i applied for k1 visa. My Fiance is from India as well. We have been in relationship for last 6 yearssssssssssssssssssssssssssssss. Finally i became Citizen so i could apply for k1 to bring him here and get married with him. Recently i went India to get enagaged with him and also submit those pics to USCIS. i was scared to do on my own to file the petition so i hire Lawyer which is just WASTE OF TIME AND MONEY! He wasted my four months just to gather all documents as he didnt know what kind of documents shud need so everytime when there is a time to submit my file he asked me to submit some random documents and got delayed more and more .i hire him because he has a good profile but i just got stuck with him. After doing lots and lots of research i found now that when we file we dnt need to submit i-864EZ and any related documents (paystub, bank statement, tax returns etc) but my lawyer did. and at that time i didnt file my 2011 tax return so for 2010 tax return my annual income is below the poverty line as i got my job in mid of may 2010. Although we not supposed to send those affidavit of support forms and proof, i am scared and tensed that USCIS will reject my file????????????????????

Please advice me if you have experiecne regarding questions below

1) What kind of paperwork or documents should i gather while waiting for NOA2???? specially what kind of original documents i need to send to India for my Fiance for future referance????

2) Having a lawyer can i fill out form i-134 (affidavit of support)? As he doesnt know anything i dnt want to delay my case over and over i want to be prepared by the time of interview.

3)According to my lawyer i (or my Fiance ) dnt have to pay for k1 visa application @ mumbai (I PAID $340 WHILE FILING I-129F) but i know that my fiance has to pay but i dnt know when, where and how so please describe it.

4)What kind of documents my Fiance need to gather except during this waiting time. what is the current standard to get PCC? as long as i know when me and family got our PCC they didnt require to have Interview letter but i guess now they need it correct me please.

5) if we need interview letter for PCC then how ahead we get interview letter from Bombay Consulate?? do we get enough time to get PCC?

i know i feel shame on myself that hiring a lawyer i have to submit all these questions to get the advice but it is a great mistake to hire him.

Extremely apperciated to everyone who read this and hoping to heard back from everyone too!

First, relax. Now that you received your NOA1, you can wait about 4-6 months before hearing from the USCIS again. Take your time to read how the whole process works, especially at the Mumbai consulate, if that's the consulate your case will be transferred to (Indian members will be able to help you).

For the documents to gather and send to your fiancé AFTER your petition is approved (NOA2), look here:

You're right, the affidavit of support form I-134 (the I-864 is needed at the Adjustment of Status stage, not for the K-1 process) and supporting documents should have not been sent with the I-129F petition package. It is needed at the interview stage. I would say, don't worry, as it is not required with the petition, I assume the USCIS won't look at it. You will send correct and more recent documents to your fiancé before his interview.

For the interview, you fiancé will have to gather birth certificate, police record, and so on... I don't know exactly which documents his consulate will ask for, look at the "Embassy Info" tab and look for your consulate. Browse the Guides tab on VJ, check the I-129F petition package checklist to see if your lawyer send all the good documents. If it misses something, you will receive a "Request for Evidence" (RFE as we say on VJ), be prepared in that case. There is definitely a lot of useful informations on VJ! :)

Like the others have said take a deep breath and relax. It's a long process and there will be plenty of time to look into everything while you wait to hear from USCIS. The best advice I can give is don't waste money on lawyers and spend a lot of time on the USCIS website (and others once you have approval). No point in starting to gather documents for the visa interview now as they may be too old by the time you get approval. Between the govt websites and this forum you should be able to figure out anything you need to know.

Thanks everyone for quick reply.

i have read all the information in VJ and it is really helpful but i would like to know from person who has been pass thru this process specially after case transfer to India (Bombay consulate). do i need signature of my lawyer on form i-134 ? because i dnt trust him any more and i dnt want help from him so i wonder if i can fill that out and submit it when it will needed?

What could be the best ans for the que regarding "WHY BOTH OF YOU DIDNT MARRY IN INDIA?" for personal reason we choose this category because i heard that it is quicker than spouse visa but it doenst seems good ans infront of them. please help me out.
