My wife which I petitioned a year ago (K1 Fiance Visa) now have a green card for two years... Now my question is, She can go for a vacation in the philippines right?

When I filed for her Green Card I filed it with Employment Authorization Document and Travel Document... How can I make sure that she can have a vacation? Are there any needed documentations? Please help.

Yes SHE CAN GO, the Green Card in itself is a re-entry permit. You don't need any other documents from USCIS. Of course she must have her valid/unexpired Philippines passport as well.

If her passport name doesn't match her green card name, she should take a copy of the marriage certificate with. If she's registered the marriage with the consulate, she can renew her passport in her married name. Then she'll no longer need to carry the marriage certificate with her. My wife and I just finished that step, and the consulate is having an outreach program in our city in August, so we'll renew her passport then in the new name and avoid the trip to Chicago which handles our part of the country.

If her passport name doesn't match her green card name, she should take a copy of the marriage certificate with. If she's registered the marriage with the consulate, she can renew her passport in her married name. Then she'll no longer need to carry the marriage certificate with her. My wife and I just finished that step, and the consulate is having an outreach program in our city in August, so we'll renew her passport then in the new name and avoid the trip to Chicago which handles our part of the country.

If she plans to naturalize, she could also wait until then to change her name. By then she would need a US passport and save that money. But it's up to you.

Yes she can go. As already mentioned, if the names don't match on the passport and Gc - make sure she takes a copy of her marriage cert with her. Other than that - enjoy the trip!

If you plan to naturalize just keep in mind no more then 6 months out of the country. Also, make sure to check her status with ICE before leaving, make sure she has no ban listed on her. The GC should be good, but always safe to check and make doubly sure.

the passport and marriage certifiacte is a must for her since she is still not naturalized as a US citizen yet.

I doubt ICE or CBP would have anything to say about whether a Green Card holder is inadmissible. I am guessing that their response would be something along the lines of, "why do you ask are you inadmissible?"

Mine went to the Phil. about 7 months after she came to USA. She still doesn't have the green card but has the EAD and the Travel Parole document. She is back home and did not have any issue.

She spent one happy month there.

I doubt ICE or CBP would have anything to say about whether a Green Card holder is inadmissible. I am guessing that their response would be something along the lines of, "why do you ask are you inadmissible?"

I agree. I think they would find that rather odd. No need to check with ICE before traveling with your valid, legal green card.

She can go. all she needs is her green card and passport. IF the names are not exact, then bring a marriage certificate to show on the return leg, the POE in the USA.

All I was saying was to make sure no ban had been issued. This may or may not reside with ICE. It is not bad to ask if you have a valid Green card. The problem is the amount of time it takes to get between bureaus. Just because of a Green card with USCIS does not mean the ban (or trigger from the overstay on the I-94) has been lifted yet. It should be, but it may take time.

If you obtained an Advance Parole Document form I-131, everything should be golden. I am not saying to worry. I am saying to always check. Just like checking your US passport or her Philippine passport to make sure it doesn't expire during your trip.

Darren, Darren, Darren. the issue of green card and ICE has been addressed, so I won't beat a dead horse. as far as AP, it does not guarantee

re entry. there are certain situations that an immigration lawyer would recommend a person not leave the country with an AP.

There's no overstay ban for Green Card holders. There may be an overstay ban for advance parole holders, but I doubt if ICE would tell you if you have a ban or not.
