AOS investigations

Hi I've hear a lot of stories about the AOS and some of them are really scarry!!!!!

Is it true that they have the FBI or some other investigations check on you to see if you live together with your wife/husband? A friend of mine told me that some people knocked at his door and went to their house to check if they were relaly living together!!! Oh my God! What happens if the husband has to work in Europe and can't live with the wife 365 days /year? Please help me ou guys....we are not very rich people (very poor actually) and we even needed a co signer for the I134 for the K3 Visa (my husband's uncle). My dream is studying Biology and be an HIV researcher someday but I can't get any grants or Financial Aid because I don't have a GC yet and I won't for a very long time....I was thinking about going to college but I don't have any money to pay....a College in North Carolina offered me a huge scholarship that will realluy save me....I barely pay anything because I get to work 7 hours a day in tthe college's laboratories and thye pay for everything. My husband works in Europe, in Rome trying to make some money....its a mess. We've been married for almost 2 years and we have always lived together (and still are). My problem is that NC scholarship is my only hope to go to College and set up a new life, realize my dreams, but my husband cannot move in there with me....do you thunk it might actually be a problem with Immigration and the AOS? Do you think they're gonna send me to jail because they think its a fake marriage or something? (after 2 years of marriage though....I don't know!) What do you think I should do in this case? Refuse everything and live poor while waiting for the GC and get a degree when I'm 30 years old or just go?

Please help me out, Im sooooo confused!!!

I have never heard of the FBI coming to your house to see if you are living with your husband.....

I think someone is spreading scare stories....

as long as you have evidence that you have a joint life together for your interview you should be fine....

I'm almost positive that the FBI has better things to do than check up on EVERY AOS applicant to see if they are living together. I think you can rest assured that that's just a nasty rumor.

I agree with Kezzie's comments that as long as your have proof of a valid marriage, such as mortgage/lease documents in both your names, joint bank accounts, joint car ownership and insurance documents, medical insurance covering both of you, and life insurance policies showing you as the beneficiary, you will be fine.

Oh My god I love you guys, I feel a lot better now!!!! ehhehe But when we'll both go to the interview do we have to tell her that I study in North carolina and he lives in Ohio, but he goes back and forth between Italy and America to work?

If there is a lot of doubt about the marriage, I believe they can do independent investigations, including coming unannounced to your home. I don't think the FBI does it, the USCIS does it.

I think it's exceedingly, exceedingly rare. Even rarer than a Stokes interview.

Since he works in Italy most of the time anyway, why not spend his "home" time in NC with you? Why not get his bills etc sent to NC? Or are you going to maintain *your* home in OH?

When you go to the interview, you will have to answer the questions that are asked truthfully. But you do not have to answer questions that are not asked.

I know a family that that happened to. Not the FBI, but Immigration turned up on their doorstep at about 7am one morning. They wanted to look around, in closets and stuff to see if the other person really lived there.

If your situation is less than conventional, the most important hing is that you are honest about it. Good luck!

never heard of FBI knocking doors for AOS Investigation..

well your marriage is valid and you have a marriage certificate they cant thrwo you in jail for not living with your husband.. u.. hv your needs to be fulfilled and hence you are forced to be apart...

Relax and chill pursue your career rather than thinking on this..

No one can tell you that it is 100% that you would not get a home investigation, but the odds of it happening to someone who came on a K visa are exceedingly low.

Document all your moves carefully (don't forget form AR-11 if you move and make sure your mail is taken care of --it is hard to change a mailing address). You have reasonable explanations for your situation and others have 'passed' their AOS while living apart for legitimate reasons.

You need to document that you and your husband see each other regularly and that you are in a real marital relationship. Keep phone records, emails, flight tickets, photos, etc. -- in addition to the normal stuff like joint finances.

While it can happen, I highly doubt that you would ever get immigration knocking on your home door. Unless they had some really substantial reasonings and suspicions as to your marriage being fradulent, I doubt they would waste their time. They are so backlogged, they can hardly manage sending letters out, let alone an actual officer!

Yeah you're right I guess. Its not like we have been married for a few months....we have actually been married for almost 2 years and we have lived together for the whole 2 years. We are currently living together in Rome, and we are planning, since I got the visa, to come back to the States by the end of march. We have tons of pics together everywhere, Ohio (with his family), here (with my family), in Naples, in Texas and we also have cards, corrispondence etc. We just need a joint account. We don't have a joint rent because we have been living here with my parents for a year and a half and we are going to live in Ohio with his parents. To open a joint account we need to stay in the States, of course, here its almost impossible to open one. Do you guys think that the fact that we have been married for 2 years (by the time I get the GC appointment it will be even more than 2 years, almost 3 I think) can help the situation?
