What name the I-485 / I-765 has been submitted with ? That's the one that is going to end up on GC. USCIS does not pick the name...

Its your choice..be it maiden or married name. yes.gif

01-30-2012: Submitted AOS application thru USPS (Chicago Lockbox)
02-06-2012: Received Text/Email, application received by USCIS
02-10-2012: Received mail/hard copy of I-131 (NOA)
02-15-2012: Received mails/hard copies of I-765 & I-485 (NOAs) / Mail for Biometrics Appt.
03-06-2012: Biometrics Appointment done
03-14-2012: Received mail for Interview Appt on 16th April 2012.
04-04-2012: EAD/AP approved
04-12-2012: EAD/AP card received ;-)
04-16-2012: Interview day - Approved! (waiting for GC)
04-23-2012: Welcome Letter touched
05-03-2012: GC on hand!

Yes, use her married name as her family name on all the forms. There is a place to put her name exactly as it appears on the I-94 on the I-485, and a place on the G-325A to put others names used. Put her maiden name in those places. Apply for her SSN in her married name too. Once she has the EAD, she should be able to get a state ID or drivers license in her new married name as well.

When she travels, you will need to use the name on her passport. If it is still in her maiden name, then bring along your marriage certificate and her green card in her married name. This will show why the passport and green card are different.

We decided to do exactly this because the SS number was issued yesterday in her married name. The marriage cert and green card will be used for travel. good.gif
