While the other thread isn't entirely relevant to this thread, it is related to this discussion. Take note of the posts by VJ member Pinay Wife. I respect her opinions.

In that case the beneficiary a Filipina was the one with the divorce issues, which is totally different than a USC. Sort of like apples and oranges sitting in the same bowl, still not the same. Aside from a divorce being part of the issue its totally different, sort of like you, a USC, being required to provide an Philippine annulment for your divorce in the USA (if you had been married before)

Yeah...it's not the same situation. I just thought I would add Pinay Wife's interpretation of the rules even though they didn't cover the issue in this thread.

I have a little different problem I was married to my ex wife in the Philippines got a divorce here in US but she never filed the papers she doesnt reqonize the divorce. We are getting back together but I got married to a Japanese woman and she divorced me. Now that Im applying to bring my ex filipina wife here with our daughter I"m concerned.

Your situation is the same wifh my aunt. Married in the philippines, got divorce here in the USA. Now she had a BF there in the PHIL. She filed for K1 . All u need is comply the requirements..

This is my aunt coversation with her attorney.

Question: Philippines are they honored the divorce papers from here in the USA even they get married in the philippines

Answer: If not dual then same as any us citizen. She can go over there and marry him then petition cr-1 or she can apply a K1

Question: Sir one more thing, what happened the record of her marriage in the philippines. Since phil. Had no divorce

Answer: It doesn't matter. She is a foriegner now

April 22, 2013 - Receive the NOA1

July 29, 2013 - Approved NOA2 ( 82 working days)

July 30, 2013 - USCIS shipped my documents to NVC

Aug 5, 2013 - Arrived at NVC Building

Aug 13, 2013 - Got the NVC case # via PHONE

Aug 14, 2013 - Got the Invoice # via PHONE

Aug 15, 2013 - Send my DS-3032 via Email

Aug 16, 2013 - AOS Pay

Aug 17, 2013 - Got an email to print the COVER SHEET

Aug 21, 2013 - send the AOS overnight at NVC

Aug 28, 2013 - Accept the DS-3032

Aug 30, 2013 - IV BILL pay and Documents Sent to NVC receive the checklist AOS.

September 19, 2013 Sent back the checklist

September 20, 2013 Sept 26, arrived @ NVC

Sept 30,2013 - already encode to their system

So you are back with your EX wife, want to petition her (and daughter) for a visa to come to the USA, the divorce was never recorded in the Philippines? I see a big issue right out of the shoot... no CENOMAR. In the eyes of the Philippines you and your EX wife are still married, but in the eyes of the remainder of the world you and your EX are divorced. For the K-1 visa you will not be able to produce a CENOMAR (as records show she is still married). With CR-1 visa you have the divorce decree stating you are both single now, so that visa process will not work, and you can not get "re-married" in the Phils as you are already married by their records. Quite a can of worms.

Only option I see available is for your original divorce decree to be recorded in the Philippines - as long as you, the USC, were the petitioner for the divorce. Once that is done then you can move forward with the visa process.
