Has anyone received RFE and sent partial documents and later, within the allowable time period, sent the rest of the documents or complete document? It happens to me and I am so scare now that my application might be denied for not sending the whole documents at once. Please share your experince or your knowledge with me.

You should NOT do that. The RFE comes with a special form and special return envelope that keeps your documents with your file. What did you send with the second part?

RFEs can get handled pretty quickly and they may have already decided to deny your petition even though it could be months before you are told that. So you send your response, it is NOT what they need and they decide to deny and off your file goes. Later your second part arrives but the file is now gone.

There is a possibilty it could be OK. IF the petition is denied you can file an I-290, motion to re-open the case and submit your evidence, ALL of it, again. This costs $585 but gets the case reopened and reviewed fairly quickly OR refile another petition which will cost $344 but takes another 5-6 months

Sending partially of documents tends to delay your petition. They wouldn't pay attention to it. Remember, there are lots of applications waiting.

The second document was sent on Monday, certified mail, with the copy of the RFE letter and it was delivered on Wednesday. However, my case status was changed on Tuesday to RFE received and in process. Would the second document be combined with the first document to complete the request? Or would the second document be ignored while the application is being evaluated?

We cannot say. Your case status would say that even if the second document was never received. "Received" means "received in the mail room" and the first one you sent would trigger that change, even if it were not "enough" to satisfy the RFE. It depends on how that particular RFE is handled by that particular adjudicator and how the mail is handled in that service center. Because you chose to send it in two separate envelopes you cannot be sure that both made it to the right person. The return envelope has notations to get it o tthe right person, what did the 2nd envelope have? Where was it directed within the service center? Is it still floating around waiting for someone to get it to the right place? If you sent it in ONE envelope this would not be a question.

If all is OK you will get an approval, no way to tell until then. As I said, if it is denied, file the I-290 within 30 days and then send ALL the evidence again with the I-290.

9/19/11: I-129F Sent

3/5/12: I-129F RFE Reply Sent

5/28/12: Packet 3 Returned via DHL

6/5/12: Packet 3 Received by Consulate, said they'd emailed Packet 4 (haven't received)

8/2/12: Consulate Interview at Montreal

I am happy to announce that I received NOA2 text and email last night despite my error of not sending the document at once as requested. The USCIS-CSC were still able to make correct decision when the second document was delivered to them. The whole RFE decision took 13 days from the delivery of the first document. I guess it is okay to send partial document when you don't have all document as requested. Although, I will not recommend doing it that way; however, if you made error for not sending requested document at once, you can send the other document later but ensure you are within the time allowable in your notice. Thanks to those who ease my fear when I was going through the RFE issue. Your response to my post is highly appreciated.

Hi EvilSquee hope you still visiting VJ forum, my RFE is exactly like the one you got, my question is did you submitted all what they were asking in your RFE previously? I mean within the I-129F original submission? Because my RFE was asking for all the evidence I submitted previously with my Original I-129F submission on November 14, 2011. My Hardcopy RFE was received on April 13, 2012 my response was received by CSC on April 20, 2012, and it is still under review, :whistle::crying:

I thought that USCIS (CSC) should adjudicate RFE response within 60 days of the day they receive the RFE response? it is their responsibility to respond to petitioner either approval or denial, any petitioner is paying fees to process their petition and obtain benefits if they qualify for it, I mean it is not neither free nor welfare service that USCIS is offering. And by the way it has been now over 20 days since CSC received my response to their RFE and my case is still under review, do you mean by your statement above that I have been denied and they are waiting to let me know later on their leisure !! :crying: : I think by sending the coded envelope with my RFE response of the same evidence package ( the 3 pound and 10 ounce, that was submitted with my I-129F original submission and got lost) unfortunately will be dropped on the desk of that adjudicator who lost all my previously submitted documents or he/she is still in job training and firing RFEs to any one without searching or doing their homework. I believe that the salary freeze imposed on Federal employees since 2011 and will continue through 2013 or may be more is depriving the USCIS adjudicator from any incentives to serve the unfortunate public. Number two is also, there is hiring freeze; the policy is to hire one employee to replace three retired ones (baby boomer era). I settled my case, what do you think..
