Explanation for I-131 Advance Parole Travel Doc?

I am currently preparing Form I-131, Application for Travel Document, as part of my adjustment of status application. It is asking me to explain how I qualify for an Advance Parole Document. I am applying simply to be prepared in cases of emergency while my adjustment of status is being processed. What should I put as an explanation?

What question are you answering? I don't see a similar question on the I-131. Note that people who apply for AP skip from part 3 to part 7. On Part 2, check the (d.) box. On part 3, you can put N/A or "none currently planned" under travel plans--you don't need to have planned a trip if you're applying for AP as an AOS applicant. This is more for people who need an expedited or emergency AP for some reason.

If you're referring to page 4 of the instructions, under Part C, note that as an applicant for AOS, subpart © applies to you, which requests evidence that you've submitted the AOS application. Subpart (b) does not apply to you (note the "OR") between subparts (b) and ©. If you file I-131 concurrently with I-485, subpart © is already satisfied.

04/28/2012: To the Netherlands for the birthday of both parents on the 2nd and 11th of May, trip is 3 to 4 weeks.

08/04/2012: To the Netherlands for our Wedding reception on Saturday the 11th of August, trip is 2 to 3 weeks.

OP says he hasn't planned any trips overseas, and it's not necessary to say that you haven't accrued 180 days unlawful presence on the AP application.

You don't put anything. As your applying because of AOS you don't include any attachment (AOS is your explanation and as you're filing concurrently you don't include anything - if you filed AFTER you filed for AOS you would include the AOS NOA1).

I guess this is a good place for my questions too. In Part 3 it asks about a planned trip, which we do have, but I also need an AP for emergencies. Can I do both on the same sheet? Where should I list that the AP would be for emergencies? On a separate page like the instructions for part 7 request? My grandparents are in their 90s, really need to be able to go for emergencies if needed.

As explained above, you do not need to furnish an explanation. AP is routinely approved for people with I-485 pending.

Re-read the instructions and slow down. You are not applying for a reentry permit. There should be no "reentry part." You are applying for Advance Parole.

This form is used for a few different purposes, so follow the instructions for Advance Parole and not the other things.

On part 7 1 (page 3 of the form), make sure to tick "more then on trip" box. this is important, it gives you a multiple re-entry AP. Not marking the box, Default is single re-entry AP.

see instructions page 4, C Advanced Parole, section 1, A AND (B or C or D or E). If applying for AOS, including with AOS or I-797c from I-485 is good enough.

If your I-94 is more then 180 days old, do not bother to apply for AP, it will be rejected.

Not true. Multiple entry will be routinely approved.

If your I-94 is more then 180 days old, do not bother to apply for AP, it will be rejected.

Not true. AP will always be approved, even if the person is not eligible to use it because of a long overstay. They do not check if the person has overstay or not. This automatic approval can create problems, as people might leave and then trigger a ban that the AP will not overcome. The AP documents comes with a warning that is is not to be used if the person has 180 days of overstay or more.

No it won't. It will be approved, therein lies the issue. People think they're okay to travel, leave and try and re-enter and get told they can't because they have a ban due to overstay.

I am confused,let's say I entered the US and get the I-94 in january 1st, does it mean that aproximately by July 1st it will be worthless to apply for a AP (my AOS is still pending until who nows when)since I have started to overstay ???

Overstay only accumulates from the time the I-94 expires, to when the AOS is filed.

So for example. Your I-94 expires January, if you didn't file AOS till July then yes it would be pointless filing AP with your AOS and EAD. However if you filed AOS before 180 days had passed since your I-94 expired (say, March/April) you could still file for an use AP technically... most recommend not to risk it unless it was an emergency. I personal filed for AP even though I had 5 months (roughly) of overstay. I never had to use it but I personally would have had I needed to as a emergency... but it would have been really stressful. Always better to file before your I-94 expires to prevent these sorts of these issues.
