Hi to everybody here - I have been visiting this forum for months and this is my first time posting. It has been so helpful to be able to read everybody's posts and not feel so alone - thank you!

Anyway, I just mailed my VAWA I-360 yesterday, and then thought about the VAWA reauthorization and read somewhere that VAWA cannot be filed until its reauthorized. Does this mean that my application will be sent back? I hope not - I have been to hell and back already! Has anybody else filed VAWA since the law expired and if so what happened with your application? Thanks!

Ok, my question is answered by the fact that I received a receipt notice and prima facie, so yes I guess they are still accepting VAWA petitions. I had read in other places that VAWA could not be filed until the bill was reauthorized as it had expired in 2011. The reason for my concern is that this was what was written by several attorneys - I am going it alone without representation and judging by the obviously false info that some attorneys are putting out there I am glad about that! Hope that is all of help to somebody!

gracekce as i said before they are taking 17/19 to adjudicate the vawa cases, and it seems when they get your vawa petition to adjudicate they didn't find enough prove in your case of the violence suffered or of the bonafide marriage. They suppose to give you an answer 30/60days after you answer the RFE, but we see cases of people waiting 4 months already.Good luck.

I understand, more proof was sent already.

The two options i have are approved or rejected. What will happened to me and my 13 years old daughter, what if is approved and what if not are we going to be deported?

xgrace if you never filed form I-485 and your form I-360 is denied they are not deporting people with Vawa denied, but if you have a I-485 pending or denied I-485 in the past, once they deny form I-360 they will start with removal proceeding.

If your Vawa is approved you have to file form I-485 and attend AOS interview, if the local office put a hold in your I-485 then Vawa Unit will submit your case to the local office and you will attend the interview.

sunshine your question is very confusing, you said you got approved in 2011 and then you said your lawyer reapplied in September 2012.Did you have your vawa approved or not in 2011? and why did he apply again?.

If you got marriage after your divorce then you cannot file Vawa based in your marriage with your first husband.
