Does He need a job

A friend of mine recently returned home from a three year work contract in Kuwait. While there he met an Indonesian he wants to marry. Knows how to file I129. But he wondered does he have to have an actual "job" where he would have a letter from an employer. At present he is back home looking for work. If not successful he may start drawing SS when he turns 62 in the fall. For affadavit of support(when he gets there) is it critical he has a job. He has huge assets and doesnt really need to work any more.

Will lack of an actual "job" hurt him. I didnt think so.

No job needed, just need to show his fiancee will not become public charge. For assets, you must show you can live 3 years at 125% poverty, approx $60,000 for family of 2.

it's income that will matter, not necessarily just a real job. and if the total from those 3 years in kuwait(and from whatever legal and documented sources) meets the poverty line requirement of uscis, then he'll more than ok =)

01-08-2009 AOS Approved! thank you Lord! no interview required!

01-16-2009 Received GC in mail

09-02-2010 Sent out application for ROC

09-08-2010 Received NOA1

09-10-2010 Received Biometrics Notice

10-06-2010 Biometrics

12-06-2010 Approved! Thank you Lord God!

12-11-2010 Received NOA2 and 10-yr GC in the mail =)

I am actually about to go through the same thing. I am in Afghanistan (where I met my fiancee) and when I return home, I will not need to work for quite some time. My fiancee and I have already filed our I-129 and I was worried too about "not being activity employed" when I am back in the U.S. Any yes, it could affect him. You just never know about the interviewer at the time. As I understand, you can base your support on your assets OR you can have a co-sponsor. This is what I am going to do just because I don't want to take any chances. I will file the Affidavit of Support and so will my co-sponsor...so there will be two. It surely can't hurt. :) Tell him good luck...and be prepared to wait it out. This is very slow and painful process.

03/21/2012: NOA1 mailed
07/15/2012: 2nd trip to Skopje
09/20/2012: NOA2 notice
10/05/2012: Attorney Received Case number from NVC
10/25/2012: Received packet 3 ( the same time I left on my flight back to the US)
11/06/2012: Medical Scheduled
11/15/2012: Interview - Denied due to "lack of proof of relationship"
11/27/2012; 2nd Interview scheduled - APPROVED!
11/29/2012: VISA IN HAND!
11/30/2012: POE NYC-JFK
12/12/2012: WEDDING!!!

02/26/2013: I-485 Filed

09/10/2013: Green card received NO INTERVIEW!!!!

Thanks. His first wife was from the Russian far east. Unfortunately that didnt work out. None of this stuff is internet or marriage broker. He has lived in these places. In Kuwait he basically lived with this lady on weekends for 3 years. Not during the week though. Obviously at this point she wants to come to the USA.

Thanks. He has a couple of million. He should be okay I would think.

Then there is absolutely no problem. He can qualify on assets alone. A job is not a requirement.
