Student Petitioner never file tax return

Do you think it's a problem in the case of K-1 where petitioner is a student, never filed tax return, because he has no income ?

At the same time, he has a co-sponsor. The thing that I really doubt is that he has never filed tax return.

You will need to show you make 125% poverty level for family of 2 plus any other dependents. Current income will probably do it, if you show you have new job based on education and have been student until now. For a family of 2, you will need approx $19,000 annual income.

Should be no problem. Both the petitioner and the co-sponsor need to fill out the I-134 though, even if he doesn't make any income and didn't file a tax return.

If he had NO income it is not a problem, simply explain that and cite the tax code that exempts him. You need to attach a tax return OR an explanation why you do not. Student, no income works. But you cannot just say "I was a student and had no income" You have to cite the tax code that allows the exemption. Google "1040-instructions" and read them.
