Hello all, I want to petition for for my nephew and niece, age 17 and 14 respectively. they are my late elder brother`s children, and their mother long passed away before i even came to the states. I have been the one supporting them from when my brother died till now. Do I have to make adoption papers for this? I wish some could advice me on which documents I will need to at some point in time and if the 17 yr old is still eligible. we all have the same family on our birth certificates. I wish you all the best, and thanks in advance.

You need to talk to a lawyer about filing a petition for them as orphans as soon as possible. Orphans have to be younger than 16, unless they are immigrating with a sibling who is younger than 16. In all cases, they have to be younger than 18. You will have to adopt them either in their own country or in the U.S.

The form is I-600, but it is complicated and most use lawyers to file it. Good luck!
