So I've thought this out more, If she applies for the tourist Visa stating that she is only here for tourism and not to visit me, perhaps later down the road when we do end up applying for a K-1 Visa, this tourist Visa would show up then she will be question why she was in the states and that upon her interview for this tourist visa she stated that she was only here for tourism and not to visit me. Considering if we apply for the K-1 Visa we would have included the information about how we came to meet and at what date.

I feel this might hurt our chances of the K-1 Visa if she wasn't honest about this tourist Visa. Now perhaps she will probably get denied, but we have agreed that she enroll in college for more studies to improve her ties to China and thus improving her chances of getting accepted for the tourist Visa.

Sure it sucks to get denied, but it'll be better in the long run. :(

I suppose everyone's guilty until proven innocent. Thank you all for your suggestions and help.

I'll leave it to her to file for the visa and see what the turnout is.

Don't suppose it,

as it's mandated by US LAW that a VO MUST PRESUME FIRST, until EVIDENCE is given to OVERCOME the presumption.

Good Luck with the rethink !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

this is the 'being too clever' part I mentioned earlier....having your GF try to conjur up a story about unaccompanied tourism or visiting some long lost, non-Chinese friend, will be so obvious to the VO that I imagine he or she will have a difficult time keeping a straight face throughout the interview....you are talking about a 'strategy' that has been used and abused countless thousands of times....better to be up front, even though it may result in a denial...once she compromises her credibility with some creative story, she will never regain it for years to come.

Yes. US immigration law states that a consular officer or CBP officer is required to assume any visitor to be an intending immigrant until satisfied that they are not. Guilty until proven innocent.

Noah why are you so rude and condescending on all of these posts? Are you a former VO yourself? Your personality definitely fits the bill.

huh? I am just stating the plain, simple truth....whenever we read postings from somebody who makes all sorts of claims about not wanting to break the law, but then have ever changing stories and plans, well....what do YOU call it? telling the complete truth? I don't think so. And just how many VOs or former VOs do YOU actually know?

No, you're not stating the simple truth. Go back and look at the stuff you post. It's incredibly rude. It's incredibly condescending.

Everytime someone asks you a question you respond by saying that their situation is more or less impossible. Take the thread about the German who wants to lose weight. He stated that his employer would grant him paid vacation, and he would be able furnish proof of that from his employer. Why do you respond telling him to go somewhere else?

Please answer my question. Are you a VO?

No I am not....I worked for several months some years ago kind of like an intern in two different consular sections, working in the fraud unit in one of them...also as a paralegal for an immigration attorney for a couple of years, but his lack of ethics made me rethink that job.

What you do not realize, mostly no doubt to a lack of first hand knowledge of how many stories are told every day to VOs around the world, is how many of those stories are not 100% true.....In spite of your assertion to the contrary, almost no one on planet earth gets a six month paid vacation, no matter what somebody writes on a piece of paper....and if the OP was truly motivated to lose some weight, the US of A would not be the ideal choice, given the average cuisine in this country...he would be better off going to India, spending several months in the boonies on a vegetarian diet and doing yoga every day...but in my humble opinion, we are not hearing the entire story.

People come to this forum asking for help with the process. They don't need comments from people like you who seem to be here for the sole purpose of dissuading people from coming to the United States. We NEED the tourism. Especially now, when our economy is not doing as good as it could be. Germany is in better shape than us right now. Why would someone leave a stable life there for an illegal life here? There is not a single educated German who would do better working illegal jobs in the United States than legal ones in Germany right now.

You seem to have a lot of faith in VOs. Act on that faith, and keep your doubts to yourself. If the VOs are as good as you say they are, they will know whether or not that man is telling the truth. And also please remember that the vast majority of people who seek tourist Visas do so for the purpose of tourism and tourism alone. That's why a good majority of them are approved every single year. The State Department publishes all of the statistics. You're free to look them up anytime that you want.

duh.....you don't get to tell me what to post or not. And what an astonishing categorical statement you made....'there is not a single educated German who would do better working illegal jobs in the US than the legal ones in Germany right now"...wow...did you interview every single working German citizen in the last 24 hours? Impressive. Or maybe not.

You prefer to believe that visa fraud doesn't exist, that there not thousands if not millions of people who will do and say anything to gain access to the US, afterwhich they depress wages, steal medical and educational benefits from American taxpayers, while whining for green cards....but that Pollyanna viewpoint is dead wrong.

And yes, I have faith in our VOs...and easy access to State Dept stats....

As I said to Noah in PM:

I also would like to hear only positive answers rather than getting negative replys. Cause that just makes a better feeling.

But I come to a Forum like this to get the best, or lets say "the next to complete" information as possible and that also includes the "bad news".

After gathering all the informations (pros and cons) I'm able to form my own opinion.

So I think it's not a bad thing at all having someone around who is always assuming the worst. The important thing is that an OP is able to make his/her own conclusions out of all answers he gets (personal attacks to be ignored).

But I agree to 31deenero that there is actualy absolutly no economic reason for a well educated german citizen to move to the US (or any other country) illegal. Economy is growing, plenty of new jobs to contract all over the country and still one of the best social systems in the world (even when it's not as good as it was decades ago). Of course there could be several other personal reasons to migrate than only economics, but I'm sure the quote of illegal immigrants from germany (or France or UK) is way way way way less than any other countries...

Just checked the statistics of B1/B2 Visas in 2011. Sadly only totals, not filtered by countrys but it's not a bad rate at all:

Issued: 4,349,087

Refused: 1,303,960

FYI: http://www.travel.state.gov/pdf/FY2011NIVWorkloadbyVisaCategory.pdf

Edit:

Here are the refusal rates by countrys:

http://www.travel.state.gov/pdf/FY11.pdf

Germany got 18.6 %... Giving me some hope ;)

First Noah is Noah and the way he works will be different from everyone else. Noah is obviously critical and deals with people with a very hard hand but what you guys have to do is find the advice in his response, correct him if he's factually wrong and move on. What makes no sense to me is why jump on his @ss (and a few others like him) when he gives his 2 cents but feel sappy when all some people has to offer are :crying:(F)(L):(:o which helps no one in any situation.

And a 'well educated German' with a flourishing economy may find it necessary to immigrate if he/she is not getting paid what they deem is fitting for their educational background, there's no upward mobility in their area of expertise in the near future in their home country or their country can't offer them a job based on the high level qualifications they possess.

to address the initial question

you have 1 in a 100 chance of getting tourist visa for college student with no job.

just let her file maybe she will be that 1 person that gets lucky.

Noah is right in that reality is harsh.

best wishes for you and your gf.
