Thanks all! So just a couple of form-related questions on the 130. For question A1, did you state that this is for your child? Under section C - questions about your relative, questions 9 and 10, did you leave those blank or write in "n/a"? ALso, for those who have filed where the other parent is alive or if joint-custody for the children, did you include anything with the 130 submission from the other parent stating that they grant permission for their child to live with you and your spouse in the US? Did you include any other supporting documentation with your submission?

When I filed for my husband, we used a lawyer who was ridiculously expensive and all she did was fill out the paperwork. Advice and guidance was extra, so i really felt duped and cheated. I figured I could do this one alone, and then as the paperwork progressed if there was a legal necessity than i would seek legal assistance.

yes please do it on ur own..with the help of vj..i filed everything for husband including Lifting of Conditions last year and the filing for our children..so you GOT THIS!! :thumbs:

Wow got RFE paper work today, ?????? did I miss a step????? Requests secondary evidence of marital relationship, IE tax return, photos, insurance blah blah. I did not see that asked for anywhere, except filing for LOC. ??? I am surprised, everyone else include this stuff?? :unsure:

wow.. thats messed up.. they didnt originally ask for any of that stuff.. i didnt send anything like that.. now i see why some ppl just send everything they can think of :angry: hope thats the last hiccup

Although the video sounds really cute :lol:CSC, NVC or the embassy won't accept any electronic media but photos are good. You should keep in mind that what establishes your petitionable relationship to your stepson is your USC status and your marriage to his father and your b/c and marriage cert are what prove that. What you should focus on now is your husband's relationship with his son... although it won't hurt your case that you already have a relationship with your stepson :) You don't need a ton of photos but ideally it would be best if you included photos that spanned from the time your stepson was a baby until now and preferably included your husband. You want the CO/IO whoever to 1. see that the child on the b/c is in fact the child at the interview 2. That your husband has been present throughout his life. I would also print out a few chat records or call logs just to show that they have regular communication and any records you have of his financial support would be good too. Just include what you have and don't stress if you don't have something. (Although these items are mentioned in the instruction form I think if a father was petitioning for his 'out of wedlock' minor child and did not have involvement in their life but a DNA test showed paternity I would think the petition, barring other problems, would get approved. I think showing these things just makes the case easier. However if they do doubt paternity they can ask for a DNA test)

Short answer

-no electronic media (won't be accepted) but you could take still from the video and print them

+photos showing son from baby to now (if you have) and preferably include his father in photos

+call log/chat records/skype log (to show communication between father and son)

+documents showing financial support (western union records for example)

My answer is based on the fact that my husband's name was not on b/c so I wanted to include as much evidence as I could. I know not everyone on here is in the same position as us but are these items similar to what everyone else sent?

yes beejay, i did send photos from infancy until present time, my husbands name is on the b/c so we sent that too but we didnt have much of ANYTHING else.. i know jamaica will almost definately be sending us for a DNA test even with his name on b/c so we shall see..

Hi everyone! This is the perfect thread for me. I just recently mailed my step-daughter's I-130 (haven't even received NOA-1 yet). A bit of background..she is 19 and living in Mexico. My husband and I were married in 2006 and he received his residency in 2008. Our case is pretty complicated though because he is not listed on her birth certificate (was never married to her mother, and she registered the birth late and put someone else's name). We tried to get the BC amended last time he was down there but it would have involved tracking down the other person which the mother was not willing to do. So, I filed the I-130 with the BC and a copy of our DNA results. I'm kind of thinking that we might still have issues and possibly have a RFE and/or have to repeat DNA?

Hi beejay,

My daughter and I just had our DNA sample taken at the US Embassy in Manila today. The DNA sample was taken at the 2nd floor, then we went to the ground floor and we submitted my daughter's passport at window 38. I asked the Filipino guy who accepted my daughter's passport if we need to come back for another interview and how long it would take for the approval of the visa. He replied, "no more interview and after they got the DNA result if it's positive we will get the visa in 2 to 3 weeks."

Wow! I'm so excited for you!!! Please please please keep,us updated on the DNA process! Here's to hoping for a super fast finish!

9/17/2011 - sent I-13

09/19/2011 - noa1 received

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

04/20/2012: NOA107/20/2012: instead of an approval, we got thrown into AP. sigh

11/01/2012: Boys' I-130 interview set for November 28, 2012.

Hi, thanks for your reply! I did the testing through an AABB testing facility but I'm expecting they may make us repeat it. The company I used told us that they would give us a break on a second test. I knew that since the BC did not have his name that we should probably submit the DNA results with the I-130. From what I understand (and this strikes me as pretty crazy) if the stepmother applies for a child born out of wedlock then they don't require all of the proof of relationship/financial support stuff like they will if the father applies. I heard that from an Attorney and found it online as well. We have all that stuff if needed so it will be interesting to see what they ask us for.

Can you post a link to where you read this online, please? I can't believe this is true, but am also praying to the high heavens that it is!!!

So I was reading the information about what to include with the 130, did you all complete the G-325a for you and the minor child? how about the 864? i didnt see either form on the 130 checklist... :help:

we got an RFE this morning.. :crying:

its asking for the LONG FORM of my birth certificate :blink: .. maybe i missed where the short form is not acceptable, ive been using the same document for all my filings w/ no problem??? :wacko:

so anyway..i will call to clarify and then i guess going to write to our regional ofc to request it, only the short form (which i sent) can be obtained from the local branches..

Also it says that they cant determine whether the children were born out of wedlock so they need more evidence of relationship.. If i had known, i would have sent in a statement describing the situation?? which i will do now and they said i can include:

proof of financial support (which we only have since he has been here, but will send that)

photographs with dates and descriptions (we sent and will send again)

military records showing them as dependents NONE

insurance policies showing them as dependents NONE

school records, business records, records of family events NONE

Lastly, there was a statement about if the father ever resided int he same house, to indicate when and where..

maybe i will ask him to have the mother to write a letter describing the relationship while he was in Jamaica?? :wacko::wacko:

yeah, kinda messed up.. it really upsets me.. they are making us track down info about relationship to the child when i know we are gonna still have to do a DNA test costing up to $500?? :angry:

and i did jus double check..nowhere does it say i have to have the LONG form.. i sent in my certified copy with the seal and everything?? :bonk:
