Hello, all, and God bless this forum! What a relief to be able to tap into advice and information from others going through the same thing we are! I just filed four I-130 petitions for my stepsons (yes...four!) and I'm gearing up for the avalanche of paperwork I'm going to need for the next steps. I thought managing everything for my husband's CR-1 visa was a headache, now it's a whole new level!

Right now the Big Bad Wolf on my list is this Affadavit of Support. Has anyone filed two or more seperate but simultaneous petitions and come across the problem I'm having in preparing the I-864? My issue is that my income is enough to sponsor three of the boys, but the fourth pushes me over the poverty limit line. However the way the I-864 is put together, you are instructed to "not include any relative listed on a seperate visa petition." So, when I get to Household Size on each form, I am tallying up Myself, Hubby, my own two dependant children and the stepchild whom that particular form is for...and my income with that formula is fine. But I know that if the other three are included it's not...but there isn't any way to account for them on the form! How confusing!!!

My husband's income more than overcomes the gap but I'm concerned about the proof of income for him since he only arrived here this past January to start working and he is subcontracted, not an employee. So he has no tax returns at all and can't get a standard letter of employment since he technically isn't an employed with the company (he will get a 1099 not a W-2). He does have pay stubs to provide as proof but I don't know how confident I am in them being accepted alone to get us clear of the income limit. And then, if I do put him and his income down on the form and go through the I-864a hooplah, should I do it for all four boys, or just the one I'm not able to sponsor alone?

Can anyone shed some light on this for me?

You account for them as dependent children, so they will count on each I-864. They are your dependents, even though they aren't here yet and you can't yet count them on a tax return. The good news is that you won't need to do the affidavits until after your husband has filed a joint tax return with you. His income will then be documented on the tax return and he will have been working more than a year by that time.

Well, that certainly would solve the problem, I didn't think we could count them as dependants! And yes, in all probability we will have reached tax time by the time we hit the NVC. In the case that we don't have time to get a tax transcript, we will be able to file with our tax return and copies of my w-2 and his 1099? Thank you so much for the clarification!

Yes, a complete copy of the tax return including W2 and 1099 forms is acceptable.

I am filing for my two stepsons simultaneously and received a checklist when i counted them both on each AOS form for household membes..So i had to count myself, my husband, my 2 chilldren and then only one of his children for each separate form.. NVC was the most confusing and longest step for us so GOOD LUCK!! We are currently awaiting our interview in october..

In what way exactly and where on the form, did you list them as household members? It makes a big difference.

Thank you for your input! When you got the RFE, had you listed the other child in the section for "Other Immigrants You are Sponsoring" (Part 3) or did you just include them in Part 5 for Sponsor's Household Size as is being suggested? Since they aren't asking for specifics on Part 5, just a tally, I'm hoping this is still the way to go since if I can't show the actual household size I'm back to the same headache.

Good luck next month!

Hi guys. I am new on this process, I am hoping for some advices here. We are going to file the petition for my daughter soon. I believe it's Cr-2. If someone has a good heart here who can tell me the requirements and tips to do will be greatly appreciated. I've been waiting for this to happen. To file the petition for my daughter. I really really miss her. It's heart breaking indeed to be away from your child. We are hoping for her arrival before the Next school year. Praying for the speedy and smooth process (cross finger)

Other than this thread, the two best starting points I found so far are these:

http://www.visajourney.com/wiki/index.php/IR-2_(and_CR-2)_Visas

http://www.visajourney.com/forums/topic/258477-stepchildren-some-questions-answers/

They are good basic guides to familiarize yourself with all the steps.

If you are still a resident and you married your USC husband while your daughter was under 18, the general recommendation is to have your husband file the I-130 Petition for Immediate Relative since the process goes a little quicker that way. That will get the ball rolling.

Good luck to you!

Thank you for your input! I counted them in the household tally only as it says NOT to list the other child in Section 3..i dont remember how the error read exactly , something about the number not matching, and when i returned the paperwork with just my 2 children, my hubby, myself and then ONE of the step children.. the paperwork was approved for each

sorry i took so long to check back in.. pray you are blessed on ur journey..this all can get so confusing.. and THANKS!

Thank you. I've read about DNA. Is that mandatory? And why?

Its not required in all cases. The interviewer will request DNA to be done if he/she wants more verification of relationship between the parent and the child.. its more common to be asked for in high fraud countries.. I know it requested a lot in Jamaica so we tried to pile on as much relationship evidence as we could for them to take to the interview even though that really doesnt guarantee you still wont get a request. My first stepson went thru the interview without it being required thank GOD..
