So we received our RFE in the mail...they are asking for DNA testing, which we sent with the original petition. HOwever, it appears that they want original results from the testing agency, not a photocopy. It just says that they lab should be accredited, but does not indicate that the testing has to be done through the Consulate so that's good news. Otherwise, it says we can submit evidence of relationship stuff like photos, school records, etc. I'm pretty sure I can call the DNA lab and have them submit results directly to the address provided and we should be good to go!

I'd say that RFE deserves a congrats gdalicia! :star:

Having the lab submit the results directly to the service center does seem to be the best option. Hopefully if it's good enough for the service center it will be good enough for the embassy.

Who knew an RFE would be good news :blink:

I'm certainly no expert but it seems like you are headed in the right direction with the school records. I think it works in your favor that your husband is on the birth certificate but someone from Jamaica would have a more qualified opinion than me. It's unfortunate that there aren't pictures, did you at one time have pictures? I would try and get creative to think of any documentation, receipts, records you might have that show your husband has been providing (emotionally and financially) for his children from the time there were born until now. Do you have any cards/letters from the children to their father? I don't know what will be the tipping point for requesting a DNA but all you can do is provide the evidence you have and hope for the best but be prepared for the request.

I don't think it will be an issue to have your sister-in-law/current guardian take them to the interview if neither of you are able to go. If a DNA is requested that can be coordinated with your husband in the U.S., that part won't delay the process.

A few questions:

How old are the kids?

Was their birth registered shortly after they were born? i.e. They weren't late registered?

How long has the sister been the guardian?

How soon after their birth did the mother leave?

Was there any formal agreement that granted your husband/his sister guardianship over the kids?

Did you husband reside with the children for any period of time?

What are the custody laws in Jamaica? Will you need anything from the mother allowing you to take the children out of the country?

Hopefully some of our Jamaica filers can weigh in on your situation.

kids are 11 and 13. registered after birth, sister has had them in their care for over a year now but not quite two years, the mother took off the duration the sister had them. my husbend was with his baby mama for almost 10 years. i got a noterized letter from the mother stating she releases all interest.

howdy my fellow parents and step parents!!!!

long time NO SEEE.. ive been gone forever seems LOL.. family cruise and school starting, its been crazy.. of course immigration has been apart of the mixup LOL.. tetting the transactions from western union was a nightmare.. they required we SEND them a request, i told him kazulie's experience and how it was allowed to make the request over the phone to try again, he called again.. they said the SAME THING, sent the request, waited, never got it so hubby called and they did it over the phone!!!!!! :bonk::bonk::bonk:

so a whole mnth went by.. i actually got my birth certificate from our State capitol before he got his transactions.. so anyways.. we sent that info in last week so we wait again..

Congrats to all of yall on zooming on past NVC.. altho it may only seem like zooming since i was reading and not LIVING it LOL.. WELCOME to all the newcomers.. we all in this together..

As long as the payment was for the correct amount and you had some documentation aside from the I-130 form your case should be accepted well before Sept. 27th. Keep an eye out for you check to be cashed this week and it's a good sign your case has been accepted and your NOA1 will be on its way.

We included all the documentation like birth certs, marriage certs etc. We sent the I-130 for my mums petition too at the same time, with all the required documents for her application, still haven't heard back for either.

With the payment, I'm worried it's wrong. We couldn't figure out how to send the money to the US as no one we knew there could do it for us, and my step-dad didn't have his US check book here. So we got a money draft or something from a bank here, that has a partner bank in the US. They said they do those kinds of payments all the time stuff like that, mum insists it's fine, but I can't help but be a bit worried seeing as we haven't heard back, and we can't check if the money has been cashed very easily - Mum would have to go into the branch to find out, but she's very busy at the moment..

Our hiccup was a notorized letter from the Mom we had to send to the NVC stating the kids were allowed to come to the US :). Miss this place but since my journey is over since last year have not come on much. hope this helps you

Hey girl i read one of your post that you were gonna get noterized letters to try to avoid paternity test. Did you hear that from a reliable source? or was that your post i read? i can't remember.

I beenc alling everyday and stillno apointment. i beenin the system they said since last monday. Two lady NVC people on the phone told me that they only do the apt scheduling in kingston the second week of the month. then last night the guy from nvc told me that is not true they use to say and do that but that i could get an apt anytime not just the second week of the month. pretty discourgaging everytime I call NVC to check status getting different information and different attitudes. it should all be the same

Received a text message that said status had changed. I logged on with trembling fingers and the I-130 has been approved!!! I am so excited. It happened a lot faster than we expected and unfortunately i dont have everything ready that we need to send in the NVC package. We dont have a passport for the baby yet so we are going to have to travel to New Orleans to the Honduras consulate to get paper work so my husband can sign off on letting her biological mother get a passport. The mom says it will take about a month to get passport and then she will have to send it to us. Sending things back and forth to Honduras has been a nightmare in the past because they dont really have addresses and so it takes forever. Anyway i know that the rest of the process is up to us as far as getting our stuff together so please pray that it is a speedy process!

Congratulations! I remember the day I got the text message and found out I was approved for I - 130. Now I am waiting for an appointment. So Yeah there's plenty to do while you wait if you understand the steps ahead of you. Wish I had understood them better. Nothing worse then knowing the ball is in your court and immigration is waiting for you instead of you waiting for them. I think the affadavit of support was the biggest pain to me. That form is why people break down and get lawyers. It's like doing taxes,,,,ick! Amazingly they informed me that I did it correct and didn't kick it back. Good luck and hopefully we may assist you anyway we can.

Anyway, so for all the Jamaica embassy waiters...no appointment here and I believe mine went in much earlier than everyone else on here. Been waiting waiting and waiting....SUCKS!

no not me lovejamaica.. i don't have any resources that have told me that.. from what ive heard of the embassy, LAST YEAR anyway, they were doing DNA for anybody they chose and frequently.. Unfortunately, it seems there is a high instance that the man is not the true father so they feel the need to test more often than they used to.. i dont know if that has changed, most of my lil group went thru this last year..
