More fun with NVC. They sent an email asking for the I-864 instead of the I-864w. The woman I talked to at NVC did not know who was allowed to file the I-864w and said I should just file the I-864. Will try and get to the bottom of this.

LUCY4 - I will let you know how this goes as I think you will be in a similar position.

Oh lord... I knew I should have waited. Tomorrow, he becomes a citizen. Lol. Im just kidding. I really hope they accept the W though, because I REALLY dont want to give them my info. Lol

In other news, I finally got my NOA1. Now that I finally relaxed after i found out that I didn't really need it. Lol

Hello!

I am so HAPPY to have found this thread! We (through my husband) are filing for my stepdaughter (age 12) to come to the US from Jamaica. It has been quite some time since I have have to do this process for him through the 1-129F, so it all seems so brand new to me again. He is now a US Citizen and we are about 6 months into the filing of the I-130. We received approval of that document on August 15th. I have read over the last 22 pages of this thread to better educate myself on the the next steps of this process as I am mainly the one doing it and of course we are anxious to have our daughter here with us. A few questions for you knowledgeable folks who post on here:

*When exactly can I file the Choice of Address and Agennt Form DS-3032? Can we "appoint" my husband as the agent since our daughter is a minor and we would rather have all paperwork generated through us in the US?

*I have heard conflicting stories about the filing of the I-864 form and which one we need to file; the I-864 or I-864W?

*Do we need to get a police record for our 12 year old daughter?

*We are very concerned about the DNA aspect of the interview. Not the actual validity of the test, but the time frame in which it could set us back. We are both planning on flying down to Jamaica for the interview with our daughter in hopes of bringing her home with us, but after reading this thread it seems that it is common for the consular offices to request DNA testing at the timeof the interview, then setting back the process even further. I am anxious to hear what others have heard or experienced going through this process via the Consular office in Kingston or elsewhere even.

I MEAN SHE STILL CAN PROCESS EMAIL AT THAT AGE ASSIGINING HER FATHER AS THE AGENT OR YOURSELF. THIS IS WHAT I DID AND MADE ME HER STEPMOTHER THE AGENT.

Hi Len, we're in process of petitioning our kids from the Philippines. How old are your kids?

To answer your question, because you are in the US and filed an I-485 with your I-130 your packet is being processed at the National Benefits Center (MSC) as an adjustment of status. Your husband's I-130 petition for your kids is being processed as an IR2 and was sent to the California Service Center (WAC). That is where their petitions will be processed until they are sent to NVC. The next step is just to wait until you get either a request for more evidence or a notice that the petition has been sent to NVC for further processing. The current processing time for California Service Center for I-130s is 5 months. So in theory it should take 5 months from your NOA date to get from California to the NVC stage of the process.

When their cases are sent to NVC is when you will have to do the I-864 for them. You will only pay one AOS fee but should have identical sets of I-864 and supporting documents for each child. You will also pay a separate IV fee for each child. You might find this thread helpful.

Well they did accept our 3032 via email, but still no IV payment showing on website yet. Maybe they have to finish reviewing AOS?? I have not heard anything on that yet

I feel incredibly bad about this. I'm trying to figure out if I got a nitpicky adjudicator or if this is the standard operating procedure for I-864w.

I would say if you did decided to try with the I-864w first, based on my timeline, it would set you back about 2 weeks. 1 week for them to receive the W and send the email request for the 864 and then 1 week to get your response (assuming you have it ready to go). But depending on where you are at with the choice of agent and IV bill it may all even out.

Really sorry I did not catch this distinction.

How long has your case been in process? USCIS still shows CSC as processing at 5 months but that hasn't been updated since the end of June. https://egov.uscis.gov/cris/processTimesDisplayInit.do

Once the CSC has finished processing the petition you should receive a notice in the mail stating that the petition is approved. The letter will have "I797 Notice of Approval" in the upper right corner. This is what is commonly called the "NOA2" on this site.

Once you receive that, the NOA2, it means your case is being sent to NVC. Once received it is currently taking about a month for NVC to input files in the system. About two weeks after you get the NOA2 you can start calling NVC (where you get to speak to an actual person!) to get your new 'MNL' case number and invoice identification number from them.

(603) 334-0700 Monday through Friday from 7:30 AM to 12:00 PM (EST)

Plan to be on hold for about 30 minutes when you call. Sometimes it is less and sometimes you will get a busy signal which I believe just means the system is overloaded.

They dont have to process the AOS paperwork first. It took mine about 10 days from 3032 and it took 7 days from AOS payment to IV payment.

The IV package was sent by courier on the 16th and now I am wondering when the case will be closed and interview date assigned. :blink:

August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

This is the situation we are in now and NVC is telling us that in order to be able to file the I-864w the petition would need to have been sent by the USC bioparent.

Don't know about Jamaica but this thread by meblue about the Manila embassy is one of the best examples of the DNA process that we have on this site. I think as long as your consulate is one where they do not accept tests before they are requested it is probably a pretty good place to start.

Sheesh and another 3 or 4 weeks waiting for interview appointment?? Then month to interview? Crapola now I wonder if she will be here by holidays!! :crying:

Ok yesterday around 3:45 I get email that NVC is waiting on my 3032, so I head home open email to ready for resend and there is another email saying I am named agent and IV bill is ready for payment. Think I still need to resend 3032 anyway??
