Hi,

I was getting documentation ready and was wondering if I had to fill out the 864 or 864W. My stepdaughter is 10 and I have been a US citizen since I was born. I live in the US and my stepdaughter lives in China.

Hi,

the i864, the i864W is for USC parents whose children will become USC after they enter the US and derive citizenship. stepparents cannot derive citizenship,

only biological or adopted children under 18 can derive citizenship from their USC parents.

What are the requirements to be considered a derivative of a petition? can you give an example. thnx

you are confusing two different things, what do you want to know? citizenship or a GC petition.

If you are talking about a petition to become LPR, a resident, derivatives are the spouses and unmarried children under 21 of the beneficiary. USC can petition married children or married siblings.

You file the I-864.

Your stepdaughter will not become a US citizen when she enter the US. Since she will not be a US citizen when she enter the US, you do not meet the requirement to use form I-864W.
