K3-if have baby

I'm US citizen and plant to file K3 application, what if mine wife (she is oversea) have a baby during the process, what procedure should I take, please advice thanks

If you meet the presence requirements then your son/daughter is entitled to US citizenship, to be applied for at the nearest US consul or embassy

Forget the K3, it is obsolete. You will be getting the CR-1 visa for your wife. If you- the dad- have been living in the USA for more than 5 years, 2 of which after age 14, then the child will be entitled to US citizenship. You wil need to file CRBA (Consular Report of Birth Abroad) to get him/ her a passport.

Currently work and live in USA...Do I do have to be there in VN for US consul or embassy when we file CRBA (Consular Report of Birth Abroad)during apply? or mine wife can take care this process? thank

HCMC will require her to have the baby and take a DNA test... and you will need DNA testing to make sure its yours... fellow VJ members have gone through this..

You wish. If it's a long term relationship where the couple was living together or some time before and after conception, a DNA test might not be requested. Vietnam is not Ireland.

Bring good solid proof of your citizenship and physical presence in the US even if you were born there as this is the primary factor for determination of eligibility for US citizenhip for a child with one USC parent and one non-USC parent

Consulate and circumstance specific, yes. Not all HCMC or Manila cases require DNA testing. It depends on the circumstances.

This is correct. This is specific to countries and each may play this differently. Vietnam is not only high fraud but there is a rumor flying around there that if one has a baby that a visa is guaranteed. This means that the consulate has to view all pregnancies as suspect.

My opinion is to try and avoid to become pregnant while going through this process. It can have heart wrenching conclusions.

Clayr knows the worst case scenario first hand... I still am in disbelief as to how that all went down...
