Regarding removal of conditions I-751 form

Hi everyone,

I need to file I-751 form for removal of conditions starting the 23rd of April 2012, and among the documents to file is jointly filed taxes ( 2011 is our first and only jointly filed tax ) , which i think they need a partial tax but i don't know what is a partial tax and do i have to wait till i get the refund back?

Also, same bank accounts, which i already got one from the bank stating when the account was opened and also the amount in it, is it OK to cover the amount?

My last question, I came to USA in July of 2010 and till beginning of March 2011, we lived with my sponsors, so we did not have bills, no rent, and i had a part time job which i filed alone ( not jointly, because my wife didn't have a job then ). the only evidence during this period is some pictures, a bank letter in our name sent to that address and car title in our names. my question is do i have to explain the lack of evidence in a separate paper so they don't have to ask for anything from that period of time, or i just send what i got and wait ?

Send everything you have, including the 2011 tax return. You don't have to wait till you get the refund. I don't know what "partial tax" means; it's not on the form instructions so I doubt it's required, whatever it is.

If your sponsors are willing, ask them to write and sign an affidavit saying you lived together as a married couple.

Why do you want to black out the amount on your bank account? Anyone can open a joint account with $0 dollars, so it's better evidence if you show there's money in it and you use it to pay bills, etc.

I don't understand why you didn't file joint taxes prior to 2011. Couples can file joint returns even if one of them isn't working; they often do because it helps reduce their taxes. You didn't file "single" did you?

I did file married but separately for 2010 taxes ( I didn't know we can can file jointly if one of us is not working ) and yes the sponsors did write us a letter saying we lived with them that period.

Don't send tax returns, send tax transcripts.

Go to the IRS website by clicking here

You need to look at 3. Either you can order them online by clicking on "Go to Order a Transcript" or you can call the number there and order them. You need them for all of the years you have filed taxes together, that should be for the last two years.

You can send a 1040 tax returns including all W-2s, 1099s, Schedules, etc. instead of a transcript. Check the directions. If he just sent 2011 Tax Return in, the IRS may not have a transcript made for him yet.

Yes, you can file married jointly even if one is not working. You might check to see if you can amend that year, if it will result in a bigger refund. The tax return is the form you send in, usually called a 1040. If you filed electronically, you should be offered something you can print out that shows what you've sent in.

Yes you can, but transcripts are preferred. Sending tax returns is a lot of unnecessary paperwork for USCIS to process. I applied for transcripts with no problems a week after I filed my taxes, took less than a week to arrive.

Thank you so much everyone,

I did ask for the transcripts for 2010 year today. 2011 isn't processed yet i guess, but will check tomorrow when will it be available.

Also, ill be sending explanation letter attached with my documents, saying i didn't know that we could have filed jointly even my wife wasn't working ( she just gave birth back at that time), and the other reason was that my sponsors whom we were living with claimed my wife and son.

Hopefully, they will understand.

other than that, ill be sending

1- My son's birth certificate. 2- Car Title. 3- Apartment Lease (2 years ). 4- Medical insurance ( 2 years ). 5-Passport and Green card. 6- Letters from people we know. 7- Bank accounts in our names. 8- Some pictures and letters. 9- last Electric, gas and cable bills in our name. 10- Costco cards.
