No, it will not cause a problem unless you fail to change the passport to match prior to the interview. The clean and easiest way to deal with the issue is to change the name in the passport to the name she will use going forward and do all future paperwork in that name.

Just to avoid any kind of confusion at all, can't I just go along with her name without the last name throughout the process. I will get her name on the passport changed after this whole immigration process. Not everyone chooses to take their husband's last name, so I don't think this would be an issue? Right?

For Indians, is it mandatory to list your spouse name on the passport after you get married, in order to use it for traveling purpose or for the visa interview?

You can do that but it will make changing the green card and the passport more difficult after arrival. Sure, first decide what name she's going to be using going forward. If no change, then no change and no problem. If there is going to be a change, now is the best time to do it. By best, I mean least trouble and least expensive, by far.

Just so that I am clear what you are suggesting Sir is to fill the I-130 now with my last name (that's what we would like to keep going forward) and her first name (she only has first name on her current indian passport), and in the section that says other names used, put all her other names listed on various Indian docs.

After I apply for I-130, start working on changing the name on her Indian passport, matching to what we filled out in the I-130 application.

You also said before that although the marriage certificate won't have any last name, and I-130 will, it shouldn't cause any issues for getting I-130 approved.

Is this all correct?

That's all correct except you do not have to wait to change the name on her passport. I would stop thinking of it as her name and your name. If she was previously just Mary and is now going to be Mary Jones, then Mary Jones is HER name. Yes, if she ever used any other names, indicate those on the G325a and the I-130 where asked.

This method will avoid all name change paperwork anywhere, ever EXCEPT in her passport.

I didn't understand this statement Sir. Could you please elaborate? You are saying, by doing what I mentioned above, I will avoid all the paperwork for name change, except for in the passport??

Sorry for asking the questions and clarifications, but I just want to make sure I am doing things correctly. Thank you for your patience.

Yes, if you change the passport name before the interview and you start using the married name now on the I-130 and all future paperwork, there will be nothing to CHANGE.....EXCEPT....the passport. The visa and green card will be issued in the passport name. You do NOT have to wait until the passport name is changed to start using the new name on immigration papers but the passport change needs to happen before the NVC stage of the process.

Hello,

I am in the middle of filing I-130 to get my wife from India. She does not have any last name (family name) on her passport. She only has a first name. Is that going to be an issue? Do I just leave the field of Last name as blank on the form?

Has any one had any issues when there is no last name?

Any help will be very much appreciated.

Thanks!!

I may tell you to get a new passport with the last name and go forward. in tatkal, it wont take more than a week
