Hi Vjers,

I hope anybody could help me here. My sister is married with American and she is now in the US (under K3 visa). She has a 6 year old daughter in Phils and filed a petition for her (K4) and still on process. Now my question 1. "is there any interview for my 6 yr old niece?" sounds non-sense but that's what they said lol. 2. how about the medical? 3. does her parents needs to come down to get her or could it be somebody?

When did your sister enter the US? Are you sure it was a K3 visa or was it a CR-1 visa? A K4 visa is a derivative of a K3, it cannot be petitioned for. Your sister's USC husband would be petitioning your niece for a CR-2 visa.

Google "follow-to-join" to see if the child is eligible for a K-4 visa as following-to-join mom on the K-3 visa. I think there's a time limit of a year, so it may not work for them. If not, the USC stepfather will have to file a new I-130 petition for the child as a stepchild (IR2 visa).

Spouse visa? I think it is K3

There are two types of spousal visas that are officially on the books, K3 which is a non-immigrant visa and a holder of this visa would need to file for Adjustment of Status in order to obtain a green card whereas the CR-1 is an immigrant visa and a holder of this visa receives a green card on arrival in the US.

She moved more than a year ago and now in GC....

Current NVC policy has made the K3 virtually unobtainable, most people who pursue it end up on the CR-1 path. The timeframe you give here fits current NVC policy.

To know the difference (and it's important to know the difference so your original question regarding your niece can be accurately answered), did your sister have to file for Adjustment of Status to obtain her green card or was her green card simply mailed to her after she arrived in the US?

1. Your niece will have an interview. Sometimes people lie about a niece or nephew being their child. The interview is to check. Sometimes children tell the truth when adults lie.

2. Every immigrant has to have a medical. Not a smart policy to let in anyone who may have a infectious disease. Immigrants have to get a medical exam.

3. Any adult can take her to the interview.
