So this is last minute, but I keep running in to issues with my taxes. I was trying to just do married filing separately, but TurboTax ran into some errors with things I put in, plus I couldn't claim my student loans and other deductions while filing separately. Can I put my husband as married filing jointly if he has only lived here since October? Is he allowed to file taxes if he lived here for a little less than 3 months before Dec. 31st? He made no income in the US last year, but had some foreign income. Can anyone help FAST! haha

I got mine done at HR Block, MFJ as soon as my husband received SSN (he arrived in Feb). Already got my refund, even though we had to send it twice becuase his # didn't register the first time (1st electronic, 2nd mail). BUT we were married all of 2011 (and he had no income anywhere). I would imagine it is more important how long you were married than how long he is here from my situation.

You can do married filing jointly as long as you were married by the end of 2011. Follow the instructions here for a statement signed by both spouses choosing resident status. http://www.irs.gov/publications/p519/ch01.html#en_US_publink1000222177

Foreign income must be reported, but some or all may be exempted from US tax if it was taxed elsewhere. http://www.irs.gov/publications/p514/index.html

husband has ssn? file a PAPER RETURN, you can get the monies deposited via ACH/direct deposit.

He will fail all internal checks and lookups with any tax prep software for electronic filing, as he has is NOT on the tax rolls with the IRS, yet.
