We emailed Kay Bailey Hutchison 3 weeks ago. No response from her. Not even a "auto response" or anything alike.
Hutchison (by the grace of God finally a lame duck) is worthless, regardless of one's party affiliation. In my time of need, I spent all day trying to reach her top staffer. When we finally connected, she cut me off with a haughty "The Senator has far more important things to do than to concern herself with one person's K-1 application."

Those words will ring in my brain forever.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I would never say to the old congressman that your services are not needed. You pay his salary and he should do the job you want. And if he happens to decide to do it on day 3 and you pulled your request on day 2....

It will not hurt your file to have 2 congressman and senator on it.

When a case is under CO review at the embassy level it does help to push the CO to work faster to issue the visa.

When you are in Mandatory AP it can push the FBI agent to finish the file quicker and not sit on it.

I know cause they sat on mine for 29 days and did nothing cause they had a backlog of cases. So within a week I contacted mine and within 12 days ap was over.

It is now your job to make those calls every few days and see if their are any updates

call DOS everyday now and ask status update

email the embassy twice a week for case status updates

send email to you congressman people and ask for the latest update and when can you expect the next congressional inquiry to be made

Update: As per your advice (thank you!) I decided to keep Senator Gillibrand's office on my case as well as contacted Senator Charles Schumer and Congresswoman Carolyn Maloney. So far I have not heard back from anyone...the last time I talked to Gillibrand's office was on 04/16 when the person I spoke to said his supervisor would make the inquiry asap... I contacted Schumer and Maloney on 04/17 and am still awaiting a response or acknowledgement of receipt of my materials....

I was hesitant to have more than one office make an inquiry only because I thought that they have to 'pull our file' for each inquiry and it may slow them from working on our case...is this true or was I misinformed? I also thought you weren't supposed to contact the embassy too often for this same reason... (but now that I think of it - it doesn't really make sense...I would think that the FBI would be working on our case continuously (hopefully) and would contact the embassy when we are cleared?)

Also does the DOS keep track of how often you call? Is it better to call often?

Thank you to everyone on here for sharing your experiences and advice! It has really helped me get through this week - it's been a tough one!

God delays but doesn't forget.

  • 2 weeks later...

Hey All,

Just wanted to follow up...after I called Senator Gillibrand's office on 04/16 and slightly freaked out because they hadn't made the inquiry yet, I finally got a letter in the mail a few weeks later saying that they were finally making the inquiry...about another week or so later I got another letter (no phone call) which said the following:

Thank you for contacting my office with your matter. I have contacted the US Embassy in London, UK on your behalf. Please find their response to my inquiry below:

Thank you for your correstpondence on behalf of Ms ... regarding Mr ...'s application for an immigrant visa. Embassy records show that Mr ...'s application is subject to additional administrative processing at this time.

We realize that these extended time periods cause frustration to applicants and their loved ones. However, the Consular Officer must adjudicate visa applications in accordance with the provisions of the law, and, in some cases, this involves extensive administrative processing. As processing varies in each case, there is no set period of time that it may take. Whilst we cannot predict when the processing of Mr ...'s application will be completed, we can assure you that he will be notified as soon as it is."

I hope this information will be of help to you. If I can be of further assistance to you, please do not hesitate to contact my office again.

I also contacted Senator Charles Schumer and Congresswoman Carolyn Maloney on 04/17 and have not heard a SINGLE thing back from either of them...not even an acknowledgement of receipt...my faith in our public officials is not so great right now...

I'm glad we finally got a response from Gillibrand's office, but it was practically the same response I got when I emailed the embassy myself. No helpful info at all...it does make me super scared that they haven't even touched our case yet since there is nothing to report...I am happy that they know a senator is (mildly) interested in our case...so maybe that will help? Who knows...this process is exhausting... I also feel like just another number they checked off their list since they didn't even bother to call me to tell me what's going on...I get it...it's a busy office with "more important" things to do...but this is our only avenue to try to help our case in this totally broken immigration system...and that should be important...

Thanks for the support everyone...just wanted to share in case this info is helpful to anyone else...

God delays but doesn't forget.

Hey VJ'ers...

For those of you who contacted your senator or congress-person...how long did they take to get back to you? I contacted my senator (Kirsten Gillibrand - New York) about a month ago (03/19) and I am still waiting to hear back...I'm sure they are busy because it's a New York office and I'm sure the embassy also takes a while to respond to the inquiry...but I'm getting anxious...I talked to them over the phone a while ago and they had all of the info they needed...but how long should I expect to wait for a response? This whole process really tests your patience...

Hope some of us hear good news this week! Good luck all! :star:

[/

she made an inquiry about my husband case 1 month ago. I think it took them to answer me 2 weeks. Also it depends of the embassy, but they have a direct line with them. Call them again

My senators aides say "the more inquiries we make into your case the further it will be delayed."

My congressman's immigration aide said "I'll inquire every week -- please call me next week for an update."

Is it true inquiries delay processing (at local office level)?

Can any of these elected officials do anything about mail processing time for evidence sent in in regards to an RFE??

No updates...I have not contacted Senator Gillibrand or my other senator and congresswoman since my last post....mostly because my last experience was like pulling teeth from them....I do want them to make another inquiry - but I have just been waiting for now...I had to take a step back for a bit - this process was getting to me too much....I feel as though it doesn't really help and I just haven't had the energy to keep fighting when it's not working...I'm thinking of contacting them again soon so I will be sure to post any updates...

cool... i am also in AP right now, its been six weeks since interview... tomorrow's my anniversary ;( anyhow, i contacted a senator's office last monday and left a voicemail so that they can get back to me, before that I had filled out a constituent inquiry form on their site, called 2 more times after that and still got no where. Decided to contact another senator today. sent a message online, and will follow up with a phone call tomorrow hopefully...

The embassy has been of no use to us. we call them every week. today the hubby called and some girl answered and told my husband that 6 weeks isn't a long enough wait (easy for her to say) and that it could be more like 7-8 months!!! she told my hubby that when its ready, they'll send him his visa in his passport to which he replied that he has his passport cuz they didnt take it from him... the grl told him to just call the embassy every 15 days and ask if the AP is done... seems like a run-around, i'd hat e to think that his AP will really last 7-8 months...
